Book excerpt: This book explores the persistence of the governance gap with respect to the human rights-impacting conduct of transnational extractive corporations operating in zones of weak governance. The authors launch their account with a fascinating case study of Talisman Energy’s experience in Sudan, informed by their own experience as members of the 1999 Canadian Assessment Mission to Sudan (Harker Mission). Drawing on new governance, reflexive law and responsive law theories, the authors assess legal and other non-binding governance mechanisms that have emerged since that time, including the UN Guiding Principles on Business and Human Rights. They conclude that such mechanisms are incapable of systematically preventing human rights violating behaviour by transnational corporations, or of assuring accountability of these actors or recompense for victims of such violations. The authors contend that home state regulation, while not a silver bullet, has a crucial role to play in regulating such conduct. They pick up where UN Special Representative John Ruggie’s Guiding Principles on Business and Human Rights left off, and propose an innovative, robust and adaptable template for strengthening the regulatory framework of home states. Their model draws insights from the theoretical literature, leverages existing public, private, transnational, national, ‘soft’ and hard regulatory tools, and harnesses the specific strengths of state-based governance. This book will be of interest to academics, policy makers, students, civil society and business leaders.

In International Trade Law and Domestic Policy, Jacqueline Krikorian explores this question by examining the impact of the WTO's dispute settlement mechanism on domestic policies in the United States and Canada. She demonstrates that the WTO's ability to influence domestic arrangements has been constrained by three factors: judicial deference, institutional arrangements, and strategic decision making by political elites in Ottawa and Washington. In this groundbreaking assessment of whether supranational courts are now setting the legislative agenda of sovereign nations, Krikorian brings the insights of law and politics scholarship to bear on a subject matter traditionally addressed by international relations scholars. By doing so, she shows that the classic division between these two fields of study in the discipline of political science, though suitable in the postwar era, is outdated in the context of a globalized world.

Schneiderman explores the linkages between a new investment rules regime and state constitutions – between a constitution-like regime for the protection of foreign investment and the constitutional projects of national states. The investment rules regime, as in classical accounts of constitutionalism, considers democratically authorized state action as inherently suspect. Despite the myriad purposes served by constitutionalism, the investment rules regime aims solely to enforce limits, both inside and outside of national constitutional systems, beyond which citizen-driven politics will be disabled. Drawing on contemporary and historical case studies, the author argues that any transnational regime should encourage innovation, experimentation, and the capacity to imagine alternative futures for managing the relationship between politics and markets. These objectives have been best accomplished via democratic institutions operating at national, sub-national, and local levels.

Renate Pratt’s new book, In Good Faith, explains why the Christian churches were among the first to publicly protest, and why they provided such cogent and determined international support for the struggle against apartheid. The Taskforce on the Churches and Corporate Responsibility is a coalition of Christian churches that for nearly twenty years was one of Canada’s leading anti-apartheid advocates. As the first co-ordinator of this Taskforce, Renate Pratt was at the centre of the early anti-apartheid initiatives in Canada and consequently is able to supply a clear and accurate view. The book traces the history of exchanges between the Taskforce and successive ministers and senior civil servants of the Department of External Affairs. It details the reluctant and weak responses offered by the Canadian government and business community right up to the time of Nelson Mandela’s release from prison. In Good Faith will be of particular interest to Canadian Christians concerned with ecumenical co-operation and with the social and political dimensions of their faith.
