A mining claim located since May 10, 1872, shall not exceed fifteen hundred feet in length along the vein or lode and three hundred feet on each side of the middle of the vein at the sur face. The locator of a mining claim has the exclusive right of pos session and enjoyment of all of the surface of his claim and of all veins, lodes or ledges throughout their entire depth, the top or apex of which lies inside his surface lines extended vertically downwards. The owner of a mining claim may follow his ledge should its dip carry him beyond his side lines extended ver tically down, so long as he does not trespass on the surface of another claim; but in no case can he go beyond his end lines, which must in all cases be parallel. A Patent can be obtained on a mining claim after $500 has been expended thereon for development or improvement, upon its being surveyed by a United States mineral surveyor, and by the payment of $5 per acre for the land to the United States Government. To Hold An Unpatented Mining Claim, not less than $100 worth of labor shall be performed or improvements made thereon each year, subject to the local laws of the State or rules of the mining district. Where several claims are held in common and are contiguous, the whole expenditure may be made on any one claim. The period within which this work is required to be done begins on the first day of January of the year succeeding the year of location. Well-equipped laboratory for the determination of minerals. The Bureau publishes. Among other things, an annual Statistical Bulletin showing by counties the output and value of all substances mined or quarried in California. From the latest bulletin of this character, covering the calendar year 1908, figures and tables given in this pamphlet are taken, in the belief that they will give the best idea of what the mines of the State are producing and what the miners are accomplishing. In addition to the mere figures of output, we have included descriptions of the uses and characteristics of many of the materials, as well as a brief mention of their occurrences. The compilation of accurate and dependable figures is an extremely difficult undertaking, and the State Mineralogist lakes the opportunity of here expressing his appreciation of the universal co-operation of the producers in making this work possible. The response to our request for early replies is particularly pleasing. A fuller appreciation of the value of early responses to the requests sent out at the beginning of each year, will result in earlier publication of the data in the future. It is the evidence herein put forth that should make us realize the magnitude of our latent mineral resources in this state. The total value for 1915 reached the sum of over ninety-six and a half million dollars, being a considerable increase over the preceding year. For the current year of 1916, there is promise of still greater results in many lines. Except for the year 1383, the gold yield for 1915 was the largest California has shown since 1864. In addition to this, many inquiries are being received relative to this state's resources in the industrial minerals, such as asbestos, chrome, magnesite, manganese and many others. Excerpt: ...the recovery of a mining title, or for damages to any such title, shall be affected by the fact that the paramount title to the land on which such mines lie is in the United States, but each case shall be adjudged by the law of possession." The only other two instances before the general law of 1866, where Congress recognized possessory rights or rules of miners, or granted a fee in mineral lands, were local in their character and application; one was section 2 of the Act of May 5, 1866, (14 U. S. Stat. at Large, 43), concerning boundaries of the State of Nevada; and the other was the Act of Juy 25, 1866, (14 U. S. Stat. at Large, 242), commonly known as the Sutro Tunnel Act. INTRODUCTION OF LODE LAW OF l866. On May 28, 1866, Senator Conness, chairman of the committee on mines and mining in the United States Senate, reported back to that body Senate bill No. 257, entitled "An Act to regulate the occupation of mineral lands, and to extend the right of pre-emption thereto," and recommended the passage of a substitute. In his report, he took strong grounds against all measures for the sale of the mines to the highest bidders and for the taxation of those engaged in working them. He claimed that it was the first duty of Congress to set at rest all doubts and apprehensions affecting mining property by the promulgation of a policy which should give full and complete protection to all existing possessory rights upon liberal conditions, with full and complete legal guarantees, and which should provide the most generous conditions looking toward further explorations and developments. He especially commends the features of the bill recognizing the rules and regulations of the miners: "Another feature of the bill recommended," says the report, "is, ...
