Fighting for Andean Resources focuses on the competing agendas for mining benefits and the battles over their impact on proximate communities in the recent expansion of the Peruvian mining frontier. The book complements renewed scrutiny of how globalization nurtures not solely antagonism but also negotiation and participation. Having mastered an intimate knowledge of Peru, Vladimir R. Gil Ramón insightfully documents how social technologies of power are applied through social technical protocols of accountability invoked in defense of nature and vulnerable livelihoods. Although analyses point to improvements in human well-being, a political and technical debate has yet to occur in practice that would define what such improvements would be, the best way to achieve and measure them, and how to integrate dimensions such as sustainability and equity. Many confrontations stem from frustrated expectations, environmental impacts, and the virtual absence of state apparatus in the locations where new projects emerged. In some cases, communities act within the formal participatory spaces, while in others, they organized "around" or "in reaction to" the institutions, using participatory procedures as focal points for escalating conflict. Communities select their strategies in response to the participatory challenges they confront. Those challenges are associated with contestation over the boundaries that determine access to participatory institutions. Contestation over the line between subnational authority vis-à-vis central-state jurisdictions heightens communities' challenge of initiating a participatory process. Disagreement over the territorial delineation of communities impacted by planned extraction creates for formally non-impacted communities the challenge of gaining inclusion in participatory events. Finally, disputes over the boundary that sets representatives of an affected community apart from the community at large intensify the community's challenge of conveying a position on extraction. This analysis of thirty major extractive conflicts in Bolivia, Colombia, and Peru in the 2000s and 2010s examines community uses of public hearings built into environmental licensing, state-led prior consultations with native communities, and local popular consultations, or referenda"--

Book excerpt: In order to bridge the lack of information on child labour and to stimulate policy interventions the IREWOC Foundation (International Research on Working Children) has undertaken action-based research in the field of the worst forms of child labour in Latin America. In 2006 and 2007 a comparative study on the Worst Forms of Child Labour was carried out in 7 different economic sectors in Bolivia, Guatemala and Peru focussing on the hazardous worst forms. The central research objectives were as follows: • to map the working and living situations of children who are working in specific economic sectors and what the consequences of this work are for their physical and emotional wellbeing. • to investigate the reasons why these children are working in these worst forms sectors. The research results were expected to give important insights into the currently polarised debate between those who state child labour is above all related to cultural considerations and those who state that economic reasons are fundamental to the phenomena of child labour. • to map the existing policy initiatives for child labourers in the worst forms and to identify the best practices. In the face of challenges imposed by achieving the Millennium Development Goals (MDGs) set by the UN, specific attention was paid to educational initiatives. Is education a useful tool in combating child labour, and vice versa, is child labour a significant obstacle to achieving universal primary education? Although the evidence from the various cases discussed in the book illustrate positive trends in terms of the worst forms of child labor, thousands of children were still found to be engaged in activities that form a direct threat to their physical, mental and moral health and jeopardize their education. This book proposes several practical recommendations for possible interventions.

This book examines the regulation of these conflicts through national, transnational and local legal processes. In doing so, it examines how legal authority is being redistributed among public and private actors, as well as national and transnational actors, as a result of globalizing forces. The book presents a case study concerning the negotiation of land transfer and resettlement between a transnational mining enterprise and indigenous peasants in the Andes of Peru. The case study is used to explore the intensely local dynamics involved in negotiations between corporate and community representatives and the role played by legal ordering in these relations. In particular, the book examines the operation of a transnational legal regime managed by the World Bank to remedy the social and environmental impacts of projects which receive Bank assistance. The book explores the nature and character of the World Bank regime and the multiple consequences of this projection of transnational law into a local dispute.
