Book excerpt: The Nation's strategic deterrent is the foundation upon which all our defense efforts are built. We simply cannot allow it to weaken or to crack, and yet we have neglected it for some time while other nations have not only invested in their nuclear systems but advanced their capability. Our strategic deterrent consists of the delivery systems, the three legs of the triad, and also the nuclear weapons themselves and the command and control over those systems. Our Minuteman III missiles were first fielded in 1970; our B-52 and B-2 bombers were first deployed in the 1950s and the 1980s; our ballistic missile submarines began entering service in 1981 and, like the other legs of the triad, have a limited lifespan. The warheads themselves were largely designed and built in the 1970s or before, and the last time a warhead was fully tested was 1991. And so, for some years some of our most brilliant scientists and engineers have been working to keep these complex machines safe, secure, reliable, and credible without being able to test the entire weapon. They have done so in aging, neglected facilities with an aging workforce. Similarly, the command and control systems for our deterrent have not received the attention something so vital should have received. And meanwhile, our potential adversaries develop and field new delivery systems and they develop and field new weapons. And confidence in the U.S. strategic deterrent erodes.

Book excerpt: Since the early 1960s, the U.S. strategic nuclear posture has been composed of a triad of nuclear-certified long-range bombers, intercontinental ballistic missiles, and submarine-launched ballistic missiles. Since the early 1970s, U.S. nuclear forces have been subject to strategic arms control agreements. The large numbers and diversified nature of the U.S. nonstrategic (tactical) nuclear forces, which cannot be ignored as part of the overall nuclear deterrent, have decreased substantially since the Cold War. While there is domestic consensus today on the need to maintain an effective deterrent, there is no consensus on precisely what that requires, especially in a changing geopolitical environment and with continued reductions in nuclear arms. This places a premium on having the best possible analytic tools, methods, and approaches for understanding how nuclear deterrence and assurance work, how they might fail, and how failure can be averted by U.S. nuclear forces. U.S. Air Force Strategic Deterrence Analytic Capabilities identifies the broad analytic issues and factors that must be considered in seeking nuclear deterrence of adversaries and assurance of allies in the 21st century. This report describes and assesses tools, methods - including behavioral science-based methods - and approaches for improving the understanding of how nuclear deterrence and assurance work or may fail in the 21st century and the extent to which such failures might be averted or mitigated by the proper choice of nuclear systems, technological capabilities, postures, and concepts of operation of American nuclear forces. The report recommends criteria and a framework for validating the tools, methods, and approaches and for identifying those most promising for Air Force usage.

The East-West strategic rivalry that dominated the global security environment for over forty years has been fundamentally and, in a number of critical ways, irreversibly altered. Yet the world continues to be unpredictable and dangerous. Relations with Russia and China have improved dramatically in the last ten years but remain uncertain. Both states continue to emphasize and modernize their nuclear arsenals. In other regions of vital interest to the United States, potential adversaries increasingly have at their disposal advanced conventional and unconventional capabilities, as well as weapons of mass destruction and the means for their delivery. Together, these and other factors, such as the ongoing revolution in military technology, have engendered major adjustments in U.S. national security policy and in the strategy and forces that support U.S. security interests. A series of U.S. government analyses, including the Nuclear Posture Review and the Quadrennial Defense Review, has guided the restructuring of U.S. conventional forces and provided the basis for the late 1997 Presidential Decision Directive on nuclear weapons policy. Further analyses and adjustments will certainly follow. As a contribution to this dynamic process, this report assesses the rationale and requirements for U.S. nuclear weapons, and the infrastructure and people that are critical to their sustainment, in the current and future security environment. By so doing, the report is intended to promote greater understanding of the issues and the measures that will be necessary to sustain deterrence in an uncertain future. The American public and its leadership in both the Executive and Legislative branches must remain informed, involved, and supportive. The purpose of this paper is to assess U.S. nuclear deterrence policy to see how it has evolved and if it is appropriate for today's changed security environment.During the Cold War the United States built an immense nuclear arsenal to deter nuclear war with the Soviet Union; a clear and valid raison d'etre. The Cold War is over; has been over for more than 10 years. The Soviet Union is gone. Our Armed Forces got a medal for it. Africa, the South Pacific, Outer Space, and Latin America are nuclear weapons free zones. Today, we have the Limited Test Ban Treaty, the Comprehensive Test Ban Treaty, an Outer Space Treaty, the Nuclear Non-Proliferation Treaty (NPT), three Strategic Arms Limitation Treaties, the Intermediate-Range Nuclear Forces Treaty, two Strategic Arms Reduction Treaties, and the Anti-Ballistic Missile (ABM) treaty. The convergent thesis of these and other international agreements is a movement to remove nuclear arsenals from the options list of nation-states. The cornerstone of the movement to create a nuclear weapons free world is the Nuclear Non-Proliferation Treaty. The NPT is a universally recognized agreement among 136 nuclear and non-nuclear nations to prevent the expansion of nuclear weapons to non-nuclear states. The days of living under the cloud of "Mutual Assured Destruction" have passed. So what is the purpose of retaining nuclear weapons in this new environment? Why are we investing tax dollars in new nuclear technology and upgrading our weapons stockpile? Where is the peace dividend?

The use and utility of deterrence in today’s strategic environment is a topic of paramount concern to scholars, strategists and policymakers. Ours is a period of considerable strategic turbulence, which in recent years has featured a renewed emphasis on nuclear weapons used in defence postures across different theatres; a dramatic growth in the scale of military cyber capabilities and the frequency with which these are used; and rapid technological progress including the proliferation of long-range strike and unmanned systems. These military-strategic developments occur in a polarized international system, where cooperation between leading powers on arms control regimes is breaking down, states widely make use of hybrid conflict strategies, and the number of internationalized intrastate proxy conflicts has quintupled over the past two decades. Contemporary conflict actors exploit a wider gamut of coercive instruments, which they apply across a wider range of domains. The prevalence of multi-domain coercion across but also beyond traditional dimensions of armed conflict raises an important question: what does effective deterrence look like in the 21st century? Based on detailed analysis of the facts and law, Professor Moxley shows that the United States’ arguments that uses of nuclear weapons, including low-yield nuclear weapons, could be lawful do not withstand analysis. Moxley opens by examining established rules of international law governing the use of nuclear weapons, first analyzing this body of law based on the United States’ own statements of the matter and then extending the analysis to include requirements of international law that the United States overlooks in its assessment of the lawfulness of potential nuclear weapons uses. He then develops in detail the known facts as to nuclear weapons and their consequences and U.S. policies and plans concerning such matters. He describes the risks of deterrence and the existential nature of the effects of nuclear war on human life and civilization. He proceeds to pull it all together, applying the law to the facts and demonstrating that known nuclear weapons effects cannot comply with such legal requirements as those of distinction, proportionality, necessity, precaution, the corollary requirement of controllability, and the law of reprisal. Moxley shows that, when the United States goes to apply international law to potential nuclear weapons uses, it distorts the law as it has itself articulated it, overlooks law in such areas as causation, risk analysis, mens rea, and per se rules, and disregards known risks as to nuclear weapons effects, including radioactive fallout, nuclear winter, electromagnetic pulses, and potential escalation. He then shows that the policy of deterrence is unlawful because the use of such weapons would be unlawful. Moxley urges that the United States and other nuclear weapons States take heed of the requirements of international law as to nuclear weapons threat and use. He argues that law can be a positive force in society’s addressing existential risks posed by nuclear weapons and the policy of nuclear deterrence.

In particular, the strategy was devised to prevent aggression involving nuclear attack by the USSR or China. Since the end of the Cold War, the risk of war among the major powers has subsided to the lowest point in modern history. Still, the changing nature of the threats to American and allied security interests has stimulated a considerable broadening of the deterrence concept. Post-Cold War Conflict Deterrence examines the meaning of deterrence in this new environment and identifies key elements of a post-Cold War deterrence strategy and the critical issues in devising such a strategy. It further examines the significance of these findings for the U.S. Navy and Marine Corps. Quantitative and qualitative measures to support judgments about the potential success or failure of deterrence are identified. Such measures will bear on the suitability of the naval forces to meet the deterrence objectives.
