Book Mighty Judgment

Download or read book Mighty Judgment written by Philip Slayton and published by Penguin Canada. This book was released on 2011-04-12 with total page 429 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Mighty Judgment Philip Slayton describes the important issues the Supreme Court decides for individual Canadians and for Canada as a nation, and the surprising and dramatic ways in which these decisions shape our future. In the Morgentaler case (1988), the court struck down laws restricting abortion, leaving Canada the only Western country without any abortion laws. In the Same-Sex Marriage Reference (2004), it decided that gays and lesbians could marry. In the Secession Reference (1998), it laid down the conditions under which Quebec could secede from Canada. In the Patrick case (2009), the court decided that the right of privacy does not stop the police from rifling through our garbage. More recently, the court administered a tongue-lashing to the federal government over its treatment of Canadian youth Omar Khadr, accused by the United States government of fighting with the Taliban. Mighty Judgment makes clear that the Supreme Court of Canada is a political institution, and that judges are politicians. But unlike other politicians, judges cannot be voted out of office. Slayton discusses reforms that will be needed, particularly in the way judges are chosen, once we recognize that the court decides policy and plays a pivotal role in governing Canada.

Book Beverley McLachlin

Download or read book Beverley McLachlin written by Ian Greene and Peter McCormick and published by James Lorimer & Company. This book was released on 2019-09-16 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: As a judge, Beverley McLachlin has had an unequalled impact on Canadian life. She stands out for her unique ability to stand up for the values and beliefs that reflect the best of Canada and Canadians. As chief justice, she led the way to assisted suicide legislation, far greater recognition of aboriginal rights and title, allowing safe injection sites for drug users and many other changes that have had a dramatic impact on Canadian life. Less well known is her work to modify the way the Supreme Court judges work together to emphasize collegiality and to encourage judges on the court to pay closer attention to real-world information about the issues they are considering. Her courageous action to defend the independence of the court and her own personal integrity when it was attacked by Stephen Harper — an incident discussed and documented fully in this book — underlines her strength of character and integrity. This book sketches Beverley McLachlin's experiences growing up in rural Alberta, attending university, becoming a lawyer and then a judge. At a time when governments were seeking qualified women for senior positions in Canada's courts, she was selected by politicians, both Liberal and Conservative, to fill progressively higher positions. Ian Greene and Peter McCormick focus on her time on the Supreme Court offering readers a balanced, informed perspective on the role she defined for herself, remarkable for her prodigious work and the clarity of her decisions. Their background as leading Canadian writers on the role of the judiciary in Canada allows them to offer an independent and readable appreciation of her contributions to Canadian life.

Available in PDF, EPUB and Kindle. Book excerpt: Canada is a global aviation powerhouse. Thanks to the British Commonwealth Air Training Plan during World War II, as well as its internationally-recognized reputation enabling an important and meaningful bridge among the nations of the world after the war, Canada — called the Aerodrome of Democracy by President Franklin D. Roosevelt — was chosen as the host of the headquarters of the United Nations’ International Civil Aviation Organization (ICAO) and influential International Air Transport Association (IATA), and has become the third-largest aerospace hub in the world. Today, thousands of Canadian aviation professionals specializing in engineering, management, finance, sales, flight operations, academics, flight training, tax, and law staff the ICAO, IATA, governmental agencies, airline companies, law and aircraft leasing firms, universities, and gigantic aerospace corporations. This Canadian expertise also resonates in today’s global training pipeline of highly skilled professionals operating winged-tubes loaded with thousands of gallons of kerosene fuelling complex and powerful engine systems in the lower levels of the stratosphere to carry passengers and/or cargo across intercontinental airways. Canadian Air Law for Pilots is entirely dedicated to pilots; its purpose is twofold: (1) to highlight the landmark Canadian legislative framework relative to aviation law, and provide an extensive review of federal decision-makers affecting pilots’ privileges, rights, and interests by reporting on their purposes, procedural rules, as well as key case law within administrative and penal law; and (2) to outline Canada’s air law for local and international applicants and trainees interested in obtaining pilot permits, licences or ratings (aeroplanes) issued by Transport Canada. This textbook is divided into four parts: Part I: Administrative Law Part II: Penal Law Part III: Aircraft in Canada Part IV: Air Law

Book The Institutes of Biblical Law Vol 1

Download or read book The Institutes of Biblical Law Vol 1 written by R. J. Rushdoony and published by Chalcedon Foundation. This book was released on 2009-11-16 with total page 779 pages. Available in PDF, EPUB and Kindle. Book excerpt: To attempt to study Scripture without studying its law is to deny it. To attempt to understand Western civilization apart from the impact of Biblical law within it and upon it is to seek a fictitious history and to reject twenty centuries and their progress. The Institutes of Biblical Law has as its purpose a reversal of the present trend. it is called "Institutes" in the older meaning of the that word, i.e., fundamental principles, here of law, because it is intended as a beginning, as an instituting consideration of that law which must govern society, and which shall govern society under God. To understand Biblical law, it is necessary to understand also certain basic characteristics of that law. In it, certain broad premises or principles are declared. These are declarations of basic law. The Ten Commandments give us such declarations. A second characteristics of Biblical law, is that the major portion of the law is case law, i.e., the illustration of the basic principle in terms of specific cases. These specific cases are often illustrations of the extent of the application of the law; that is, by citing a minimal type of case, the necessary jurisdictions of the law are revealed. The law, then, asserts principles and cites cases to develop the implications of those principles, with is purpose and direction the restitution of God's order.

Book The End of the Charter Revolution

Download or read book The End of the Charter Revolution written by Peter J. McCormick and published by University of Toronto Press. This book was released on 2014-12-15 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Canadian Charter of Rights and Freedoms became an entrenched part of the Canadian Constitution on April 17, 1982. The Charter represented a significant change in Canadian constitutional order and carried the courts, and the Supreme Court in particular, decisively into some of the biggest controversies in Canadian politics. Although the impact of the Charter on Canadian law and society was profound, a new status quo has been established. Even though there will be future Charter surprises and decisions that will claim news headlines, Peter J. McCormick argues that these cases will be occasional rather than frequent, and that the Charter "revolution" is over. Or, as he puts it in his introduction, "I will tell a story about the Charter, about the big ripples that have gradually but steadily died away such that the surface of the pond is now almost smooth." The End of the Charter Revolution explores the Canadian Charter of Rights and Freedoms, beginning with a general historical background, followed by a survey of the significant changes brought about as Charter decisions were made. The book addresses a series of specific cases made before the Dickson, Lamer, and McLachlin Courts, and then provides empirical data to support the argument that the Charter revolution has ended. The Supreme Court has without question become "a national institution of the first order," but even though the Charter is a large part of why this has happened, it is not Charter decisions that will showcase the exercise of this power in the future.
