Book World Investment and Political Risk 2013

Download or read book World Investment and Political Risk 2013 written by Multilateral Investment Guarantee Agency and published by World Investment and Political. This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Annotation Breach of contract is a hot topic in risk management, especially in the context of Public-Private Partnerships for large utility, infrastructure, or mineral resource exploitation projects around the world. Some claims are related to economic crisis, but more often disputes arise from political change, privatization reviews, environmental regulations and governance/corruption issues. Some recent high profile cases involving government tariff renegotiations and award settlements underline the importance of this topic for international investors. Claims of breach of contract often bring about an abrupt termination of activities or force contract renegotiations that subtsantially alter the original terms of the deal and projected financial validity. This study offers significant new data and analysis to allow an informed assessement of current developments and underlying trends, in a new collaboration between the World Bank Group (IBRD, MIGA, and ICSID) and Washington University in St. Louis.

Book Transnational Law and Local Struggles

Download or read book Transnational Law and Local Struggles written by David Szablowski and published by Bloomsbury Publishing. This book was released on 2007-01-29 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: The global spread of transnational mining investment, which has been taking place since the 1990s, has led to often volatile conflicts with local communities. This book examines the regulation of these conflicts through national, transnational and local legal processes. In doing so, it examines how legal authority is being redistributed among public and private actors, as well as national and transnational actors, as a result of globalizing forces. The book presents a case study concerning the negotiation of land transfer and resettlement between a transnational mining enterprise and indigenous peasants in the Andes of Peru. The case study is used to explore the intensely local dynamics involved in negotiations between corporate and community representatives and the role played by legal ordering in these relations. In particular, the book examines the operation of a transnational legal regime managed by the World Bank to remedy the social and environmental impacts of projects which receive Bank assistance. The book explores the nature and character of the World Bank regime and the multiple consequences of this projection of transnational law into a local dispute.

Book Privatizing Peace From Conflict to Security

Download or read book Privatizing Peace From Conflict to Security written by Allan Gerson and published by Martinus Nijhoff Publishers. This book was released on 2022-06-08 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: Privatizing Peace: From Conflict to Security pinpoints the weaknesses in the numerous peacekeeping missions of recent decades, as well as the blind spots in the thinking that guided them. Even more significantly, they clearly demonstrate the ways in which well-meaning stabilization and reconstruction programs fail to accommodate the economic and social imperatives of war-torn societies. But this visionary work is not merely an indictment of First World myopia in the face of Third World devastation. The authors offer cogent, well-thought-out recommendations, firmly grounded in current reality, with a powerful determination to avoid the repetition of past mistakes. Published under the Transnational Publishers imprint.
