Book Breathing Life Back Into Intent

Download or read book Breathing Life Back Into Intent written by John Pollock and published by . This book was released on 2015 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Housing advocates alleging systemic racism in the provision of housing services can take two litigation paths: discriminatory intent (Fifth and Fourteenth Amendments to the U.S. Constitution, 42 U.S.C. §§ 1981 and 1982, Title VI of the Civil Rights Act of 1964, or Title VIII of the Civil Rights Act of 1968, also known as the Fair Housing Act) and disparate impact (Title VIII).1 While advocates have turned frequently to the latter in recent decades, the former has been relied upon less (save where there is direct evidence of intent). This is due in part to Village of Arlington Heights v. Metropolitan Housing Development Corporation (intent cannot be proved by evidence of disparate impact alone) and Personnel Administrator of Massachusetts v. Feeney (foreseeability and inevitability of discriminatory impact cannot alone prove intent; defendant's action must have been taken “at least in part 'because of,' not merely 'in spite of,' its adverse effects upon an identifiable group”), as well as the fact that the very meaning of “discriminatory intent” has become inconsistent and the methodology for proving it unclear. I intend for this article to be a road map through this complex doctrine since reinvigorating discriminatory intent is critical given the fragility of the disparate impact cause of action. While proving intent may be difficult, making creative use of evidence and applying intent tests developed in other areas (such as school discrimination) to housing cases are possible. In fact, the U.S. Supreme Court says that “an invidious discriminatory purpose may often be inferred from the totality of the relevant facts.” And Arlington Heights notes the relevance of “such circumstantial and direct evidence of intent as may be available.”

Book The Integration Debate

Download or read book The Integration Debate written by Chester Hartman and published by Routledge. This book was released on 2009-09-11 with total page 487 pages. Available in PDF, EPUB and Kindle. Book excerpt: Racial integration, and policies intended to achieve greater integration, continue to generate controversy in the United States, with some of the most heated debates taking place among long-standing advocates of racial equality. Today, many nonwhites express what has been referred to as "integration exhaustion" as they question the value of integration in today’s world. And many whites exhibit what has been labeled "race fatigue," arguing that we have done enough to reconcile the races. Many policies have been implemented in efforts to open up traditionally restricted neighborhoods, while others have been designed to diversify traditionally poor, often nonwhite, neighborhoods. Still, racial segregation persists, along with the many social costs of such patterns of uneven development. This book explores both long-standing and emerging controversies over the nation’s ongoing struggles with discrimination and segregation. More urgently, it offers guidance on how these barriers can be overcome to achieve truly balanced and integrated living patterns.

Book Classic Readings in Urban Planning

Download or read book Classic Readings in Urban Planning written by Jay Stein and published by Routledge. This book was released on 2018-02-06 with total page 762 pages. Available in PDF, EPUB and Kindle. Book excerpt: This new edition of "the best anthology in planning" includes 33 selections by many of the profession's most respected thinkers and eloquent writers. Returning editor Jay M. Stein chose the articles, about half of them new to this edition, based on suggestions from colleagues and students who used the first edition, recommendations from planning scholars, awards for writing in the field of planning, and his own review of recent planning literature. Classic Readings in Urban Planning offers an unparalleled depth of coverage and range of perspectives on traditional aspects of planning as well as on important contemporary issues. This is an exceptional main or supplementary textbook for advanced undergraduate or beginning graduate level students in urban and regional planning. As a general overview of the field of urban planning, it is also an excellent choice for planning commissioners, practicing planners, and professionals in related fields such as environmental and land use law, architecture, and government. An abstract introduces each reading, and each section includes suggestions for additional readings suitable for more extensive study. Many of these are also "classics" that could not be included as a main selection.

Book Non Discrimination Law Comparative Perspectives

Download or read book Non Discrimination Law Comparative Perspectives written by Rodrigues and published by Martinus Nijhoff Publishers. This book was released on 2023-09-20 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection, which stems from the International Conference on Comparative Non-Discrimination Law held at Utrecht, The Netherlands, in June 1998, covers both the general aspects of equality and non-discrimination law (Part I), as well as the specific grounds for discrimination, adverse impact or indirect discrimination, and affirmative action (Part II). Part III discusses diverse aspects of the enforcement of non-discrimination law; Part IV contains conclusions and an agenda for change. This book is unique in that it both provides a comparative view of anti-discrimination law in theory and practice, and looks at a wide range of grounds for discrimination, such as gender, race, religion and health. Its comparative and international approach renders this publication not only of interest to civil rights lawyers, but to all those engaged in human rights and comparative law.

Download or read book Constitutional Law written by Steven D. Jamar and published by Aspen Publishing. This book was released on 2017-02-28 with total page 1322 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional Law: Power, Liberty, Equality presents most of the constitutional law cases generally considered canonical and, with one important exception, follows the tried and true organizational means widely used in constitutional law texts of dividing chapters and sections are along subject matter lines such as the Commerce Clause, equal protection, freedom of expression, and so on. Nonetheless, this book differs from other constitutional law textbooks in important ways. The text introduces cases by providing contextual information and by explicitly articulating much of the black letter law being introduced. Under this structure the cases provide the student with the opportunity to more easily see the difference between the doctrine per se and how it is actually developed and used by the Court. Cases become examples of the rules being applied and vehicles for deeper exploration of broader principles and themes.
