El trabajo pretende dar a conocer las principales contribuciones del padre de la historiografía española, Marcelino Menéndez Pelayo, a la idea del Derecho y de la Justicia, expuestas a lo largo de toda su obra y concernientes al Derecho Romano, Historia y Filosofía del Derecho, Derecho Político y Constitucional, Derecho Administrativo, Derecho de Gentes y Derecho Penal para concluir que el historiador de Santander, si bien no fue jurista de profesión, sí fue un muy estimable jurista de formación, cuyas ideas sobre la contextualización histórica del Derecho influyeron en reputados juristas sedicentes discípulos suyos como Eduardo de Hinojosa, Rafael de Ureña, Rafael Altamira, Adolfo Bonilla y San Martín, Eloy Bullón o Gabriel Maura.
