Book excerpt: Excerpt from Memorial of the Seneca Indians, to the President of the United States With the consent of the then President ofthe United States, a delegation from the society of Friends visited those Indians, and enquired into their complaints, and having gained such in formation as they could obtain, they were fully convinced that the treaty referred to, had been effected by very objection able means, without the agency or consent of a great majority ofthe Nation. Committees of Friends representing the Yearly Meetings of Baltimore, Philadelphia, New York and Genessee, were accordingly appointed to extend such assistance to these Indians in the premises as they might be enabled to render; the result was, that a compromise arrangement was agreed Upon between the parties, by which about fifty-three thousand acres of their land-3 were relinquished back to the Senecas. Book excerpt: Excerpt from Report on the Memorials of the Seneca Indians and Others: Accepted November 21, 1840, in the Council of Massachusetts The "Friends," with that liberality and Christian spirit for which their society has always been distinguished, have had a settlement among the Senecas for many years, at which the Indians have been instructed in the rudiments of learning, and in agriculture, and the mechanic arts. It is natural for them to feel a deep interest in those who have so long been under their guidance and protection. From a very early period Massachusetts has been, to a certain extent, the guardian of the Senecas; and they now come to us, and entreat our intervention to save them from the loss of all the lands and improvements they possess. The Senecas claim to own four large and valuable tracts of land in the state of New York, called "Reservations," and which are as follows, viz. Book excerpt: Excerpt from Publications of the Buffalo Historical Socity, Vol. 7 In sending the treaty to the Senate, Jan. 14, 1840, Presi dent Van Buren declared that in his opinion the signatures had been obtained by fraud, and that the treaty ought not to be ratified. After being debated, through a period of eleven days, the vote stood nineteen to nineteen, and the treaty was ratified by the casting vote of R. M. Johnson, the Vice President, in the affirmative. A memorial, signed by sixty seven Seneca chiefs, begged that no appropriation be made to carry out the treaty, as they did not wish to leave their homes in New York. In the next year - 1841 - several peti tions were sent to Congress, asking that the Indians be for Cibly removed; but before action was taken, the committee was discharged from further consideration of the petitions. Governor Everett of Massachusetts, in his message of 1839, expressed the view that if the State had known all that it had since learned, it would not have consented to the request of the Ogden Company. Governor William H. Also, Drafts of a Proposed Memorial to Congress, and a Bill to Enable Them to Lease and Divide Their Lands The principal design of the Committee of the Society of Friends in preparing the annexed statement, is to show the Seneca Indians in the State of New York, the character of the title to the lands they occupy under the decisions of the Courts of the United States, and the Courts of the State of New York. It is known to them that the Government considers all Indians its wards, and as such, under its special protection and oversight. It has charge of their funds, and the annuities they are entitled to are annually paid to them by its officers appointed for the purpose. The history of the origin of the right which certain citizens of the United States have to extinguish, by purchase, the title of the Seneca Indians to their reservations, when they are willing to sell them, has been derived from authentic sources, and is printed, with the legal decisions respecting it, in order to give them a clear understanding of that right. It appears from the decisions of the Courts, as well as the articles of the treaty of 1794, quoted therein, that the Indian occupants cannot be deprived of their lands without their consent. They are "to remain theirs until they choose to sell them," and they are not subject to taxation of any kind. The extracts from laws and decisions of courts, which are added, contain information respecting their rights, which should also be understood. The draft of a Memorial, and the Act which it is proposed Congress shall be requested to pass, are also printed, in order to give an opportunity for all interested in the latter, to examine and carefully consider, before they are presented for the action of that body.
