Schermerhorn, commissioners on the part of the United States, and the chiefs, headmen, and people of the Cherokee tribe of Indians, ceding to' the United States: all the lands owned, claimed, or possessed by the Cherokee nation east of. The river Mississippi, and providing for their re moval to the country designated and set apart for the Cherokees west, under former treaties: And whereas the chiefs, national committee and council, and the people of the Cherokee nation east, in general council assembled at Red Clay 'on the 28th: of September, 1836, have solemnly declared that the makers of said compact, who are represented as acting on the part of the Cherokees, and who assume the style of chiefs 'and headmen, hold no such title or designation from the Cherokees, nor have they received authority from the nation to, form said instrument, and therefore disclaim and utterly reject the Same in its principles and all its provisions: And whereas a delegation have been appointed to make a respectful memorial to the Government of the United States, in behalf of the Cherokee people, praying that the said instrument be set aside, as a fraud upon the Government'of the United States and an act of Oppression on the Cherokee people, and invested with full powers to enter into ar rangements for the final adjustment of all their difficulties: And whereas said delegation have, in pursuance of their instructions, conferred with us on the subject of our acting in concert with them in their efforts to prov: cure the rescinding of said. Book excerpt: This petition of the Cherokee Nation was presented to the United States Congress in January of 1832 by a delegation comprised of John Martin, John Ridge and William S. Coodey. The delegation explains that the Cherokee Nation is in crisis as Georgia has become increasingly aggressive in encroaching upon the Cherokee territory. They claim to be appealing to Congress because President Jackson has refused to answer any of their appeals by upholding treaties concluded between the U.S. and Cherokee Nation, and they beg to be saved from forcible removal through legislative action. The delegation outlines ways in which Georgia has extended oppressive laws over the Cherokee Nation in violation of various compacts and complains of the Georgia militia presence in their nation as well as illegal surveying, settlement and confiscation of property. The Cherokees insist that such actions do not qualify as a "peaceable" or "reasonable" extinguishment of the Cherokees' title.
