Available in PDF, EPUB and Kindle. Book excerpt: The legal status of the institution of diplomatic asylum really presents two separate questions. (I) Is there evidence that states have regarded the practice of granting such asylum to political refugees as sanctioned by a rule of international law? (2) Assuming this to be the case, does the available evidence make it possible to define a "political refugee" and to determine which party to a dispute has the right to decide upon this question? While in many cases the two questions are not dearly separated in the discussions between the parties involved, they will be treated separately in the following pages. Part one will attempt to answer this question: Assuming the political nature of an offence can be establish ed, is there evidence that states have regarded the practice of granting diplomatic asylum as sanctioned by a rule of international law? Obviously, the two questions cannot be separated entirely but it seems advisable to try to isolate them as much as possible. CHAPTER I NATURE AND SCOPE OF THE PROBLEM The term "asylum" is used to identify such a variety of phenomena that the following distinctions must be made before the problem can be properly discussed I. Between diplomatic and territorial asylum. The importance of this distinction was pointed out by the International Court of Justice in the Colombian-Peruvian Asylum Case,l often referred to as the Haya de la Torre Case.

Download or read book The Southern Cone and the Origins of Pan America 1888 1933 written by Mark J. Petersen and published by University of Notre Dame Pess. This book was released on 2022-03-15 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book traces the history of Argentine and Chilean pan-Americanism and asks why pan-Americanism came to define inter-American relations in the twentieth century. The Southern Cone and the Origins of Pan America, 1888–1933 offers new perspectives on the origins of the inter-American system and the history of international cooperation in the Americas. Mark J. Petersen chronicles the story of pan-Americanism, a form of regionalism launched by the United States in the 1880s and long associated with U.S. imperial pretensions in the Western hemisphere. The story begins and ends in the Río de la Plata, with Southern Cone actors and Southern Cone agendas at the fore. Incorporating multiple strands of pan-American history, Petersen draws inspiration from interdisciplinary analysis of recent regionalisms and weaves together research from archives in Argentina, Chile, the United States, and Uruguay. The result is a nuanced and comprehensive account of how Southern Cone policy makers used pan-American cooperation as a vehicle for various agendas—personal, national, regional, hemispheric, and global—transforming pan-Americanism from a tool of U.S. interests to a framework for multilateral cooperation that persists to this day. Petersen decenters the story of pan-Americanism and orients the conversation on pan-Americanism toward a more complete understanding of hemispheric cooperation. The book will appeal to students and scholars of inter-American relations, Latin American (especially Chile and Argentina) and U.S. history, Latin American studies, and international relations.

Download or read book Immigration and Nationalism written by Carl Solberg and published by University of Texas Press. This book was released on 2014-11-06 with total page 243 pages. Available in PDF, EPUB and Kindle. Book excerpt: “Dirtier than the dogs of Constantinople.” “Waves of human scum thrown upon our beaches by other countries.” Such was the vitriolic abuse directed against immigrant groups in Chile and Argentina early in the twentieth century. Yet only twenty-five years earlier, immigrants had encountered a warm welcome. This dramatic change in attitudes during the quarter century preceding World War I is the subject of Carl Solberg’s study. He examines in detail the responses of native-born writers and politicians to immigration, pointing out both the similarities and the significant differences between the situations in Argentina and Chile. As attitudes toward immigration became increasingly nationalistic, the European was no longer pictured as a thrifty, industrious farmer or as an intellectual of superior taste and learning. Instead, the newcomer commonly was regarded as a subversive element, out to destroy traditional creole social and cultural values. Cultural phenomena as diverse as the emergence of the tango and the supposed corruption of the Spanish language were attributed to the demoralizing effects of immigration. Drawing his material primarily from writers of the pre–World War I period, Solberg documents the rise of certain forms of nationalism in Argentina and Chile by examining the contemporary press, journals, literature, and drama. The conclusions that emerge from this study also have obvious application to the situation in other countries struggling with the problems of assimilating minority groups.
