Por meio da análise da evolução conceitual da soberania, formalizada com a afirmação histórica dos direitos humanos, busca-se demonstrar sua relativização e consequente mitigação em prol destes direitos estabelecidos. O princípio da soberania diante das modificações ocorridas no direito internacional dos direitos humanos enfraqueceu a noção clássica do Estado soberano. Destaca-se o fato de o direito ambiental passar a ser visto como um direito humano em si mesmo. O meio ambiente é um bem humano básico que não comporta exceções, sendo interesse universal a existência de mecanismos de controle de proteção convencionais e não-convencionais. É possível conhecer como é a atuação dos mecanismos convencionais criados por convenções específicas de direitos humanos, bem como os mecanismos não-convencionais, derivados, em regra, de instrumentos não vinculantes. Aqui serão vistos os sistemas global e regional de proteção e promoção dos direitos humanos, as formas como estes sistemas instrumentalizaram e criaram ferramentas para a persecução do ideal dos direitos humanos. Neste livro busca-se discorrer sobre os instrumentos não-convencionais celebrados no âmbito regional, tendo a Organização dos Estados Americanos (OEA) como o principal fórum de diálogo na promoção, intercâmbio e cooperação dos direitos humanos ambientais, demonstrando-se a transposição do plano conceitual/teórico ao prático.
