Book excerpt: Today's defense environment is placing growing pressure on defense policymakers to be nimble and adaptive, particularly with respect to acquisition systems and processes. This occasional paper is one in a series drawing upon the expertise of core RAND Corporation staff to explore issues and offer suggestions on topics that are likely to be of critical importance to the new leadership: the use of competition, development of novel systems, prototyping, risk management, organizational and management issues, and the acquisition workforce. The papers are designed to inform new initiatives for markedly improving the cost, timeliness, and innovativeness of weapon systems that the Department of Defense (DoD) intends to acquire. In some cases (especially in the procurement of major systems where the nonrecurring cost is large), it may be less costly for the government to forgo competition and to rely on a single supplier. In this paper, we compare the characteristics of a typical business market to those of defense acquisitions and then identify the benefits and drawbacks of competition in defense acquisitions specifically. Using historical data and RAND's cost reduction savings methodology, we also show how DoD can determine when the introduction of competition during production is a reasonable acquisition strategy.

How successful have the components been at promoting contracting opportunities for small businesses? How has DoD shifted between fixed-price and cost-plus contracts as guidance evolved? Did the recent reforms and legislation shift components' acquisition portfolios? Have the components shifted away from certain contract vehicles? The multidimensional impact of competition on price and non-price aspects of weapon system production and acquisition are discussed. The importance of cost quantity relationships for measuring the effect of competition on price and the theoretical basis of those relationships are reviewed. The problems of and the techniques for accomplishing the transfer of technology associated with competition for production contracts are briefly outlined. Previous estimates of savings due to competition are reviewed, and their underlying methodology criticized. It is proposed that the introduction of competition be analyzed as an investment. The eventual reductions in procurement costs must be balanced against the initial costs of introducing competition and establishing a second source. The opportunity cost of government funds should be incorporated by calculating the net discounted present value or the rate of return of introducing competition for the procurement of a particular system. Finally, conclusions and policy recommendations are presented, based upon both empirical analyses and qualitative findings from interviews.

Book excerpt: Public procurement and competition law are both important fields of EU law and policy, intimately intertwined in the creation of the internal market. Hitherto their close connection has been noted, but not closely examined. This work is the most comprehensive attempt to date to explain the many ways in which these fields, often considered independent of one another, interact and overlap in the creation of the internal market. This process of convergence between competition and public procurement law is particularly apparent in the 2014 Directives on public procurement, which consolidate the principle of competition in terms very close to those advanced by the author in the first edition. This second edition builds upon this approach and continues to ask how competition law principles inform and condition public procurement rules, and whether the latter (in their revised form) are adequate to ensure that competition is not distorted. The second edition also deepens the analysis of the market behaviour of the public buyer from a competition perspective. Proceeding through a careful assessment of the general rules of competition and public procurement, the book constantly tests the efficacy of these rules against a standard of the proper functioning of undistorted competition in the market for public procurement. It also traces the increasing relevance of competition considerations in the case law of the Court of Justice of the European Union and sets out criteria and recommendations to continue influencing the development of EU Economic Law.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel.
