Book excerpt: This paper surveys and critiques various methods of measuring nontariff trade measures (NTMs) for the purpose of determining which seem most promising for facilitating the process of reducing the trade-distorting effects of such policies through multilateral negotiations. Four measurement methods are analyzed: price-impact measures, quantity-impact measures, frequency-type measures, and welfare measures. The general conclusion is that, despite a host of difficulties, theoretical and empirical analysis has progressed sufficiently far to enable reasonable measures of nontariff policies to be made that are useful for assessing relative sectoral protection across countries and monitoring changes in protection and subsidization levels over time. Tariff and subsidy equivalents, preferably determined by directly comparing distorted and non-distorted prices, are the most useful forms of measurement, since they focus on the price-distorting effects of NTMs and are also concepts with which public and private officials are already familiar. However, the various other types of measures can be valuable in supplementing the information obtained from tariff and subsidy equivalents.

Chapter one discusses the newly revamped non-tariff measure (NTM) classification system, the data collection effort so far, and the key characteristics of the data. It also highlights the private-sector view that NTMs should support domestic firms' competitiveness across countries. Chapter two describes the analytics of an NTM review, step by step through the key questions, for example, is there a market failure, which market is affected, what are the costs of regulatory action vs. the risks of deregulation, and explains how to answer these questions and how to go about quantification when it is possible. Chapter three focuses on the institutional setup and key principles required to successfully pursue the streamlining of regulations. Since the mid-1990s, developed countries have introduced new regulatory approaches aimed at improving the quality of the decision-making process by enhancing both the analytical framework used by policy makers and the participation of interested parties in the regulatory process. Finally, chapters four and five provide practical examples of streamlining NTMs. Chapter four overviews selected experiences with tackling the trade regulatory agenda at both country and regional levels. Chapter five presents case studies on streamlining NTMs, including technical regulation and prohibition, particularly illustrating the analytics that may support the review process. Finally, NTM reviews should be seen as part of national competitiveness agendas rather than as concessions to trading partners. When NTMs are perceived by the domestic private sector as hampering access to key inputs, business regulatory reviews should naturally lead to NTM reviews. Joint use of the triangle of products will facilitate the adoption by governments of coherent national competitiveness strategies centered on the reduction of trade costs.

Book excerpt: With the success of the World Trade Organization and its predecessor, the General Agreement on Tariffs and Trade, in reducing conventional tariff barriers, much of the recent focus of regional and multilateral trade agreements has switched to non-tariff measures, both border and behind-the-border policies. This paper considers the recent empirical and theoretical literature on non-tariff measures in the world trading system. It provides a set of stylized facts based on available data on non-tariff measures and reviews the key methods used to estimate their trade impact. It considers the theoretical treatment of these measures in the trade literature with a focus on the rules and institutions that govern non-tariff measures in the world trading system. It discusses some of the major issues regarding international cooperation in these policy areas, in particular whether such cooperation should entail deep integration (involving precise legally binding obligations) or shallow integration (which allows countries greater discretion in the setting of non-tariff measures). Finally, this paper reviews some of the specific features the World Trade Organization uses in dealing with non-tariff measures such as national treatment rules and non-violation complaints, and considers policy options beyond the WTO such as harmonization and mutual recognition of standards.

This study assesses currently available methods for quantifying such barriers and makes recommendations as to those methods that can be most effectively employed. The authors focus both on the conceptual issues arising in the measurement of the different types of nontariff barriers and on the applied research that has been carried out in studies prepared by country members of the OECD Pilot Group and others seeking to quantify the barriers. Nontariff barriers include quotas, variable levies, voluntary export restraints, government procurement regulations, domestic subsidies, and antidumping and countervailing duty measures. The authors discuss the many different methods available for measuring the effects of these and other nontariff barriers.
