Book Means of Transportation and Registration of Nationality

Download or read book Means of Transportation and Registration of Nationality written by Vincent P. Cogliati-Bantz and published by Routledge. This book was released on 2015-05-22 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the concept of nationality of means of transportation in terms of jurisdiction in international law. It reassesses the definition of nationality and explores how it is conferred. The book first places nationality in the broader perspective of jurisdiction in international law, and examines the historical development and necessity of the nationality of means of transportation. It goes on to investigate whether and under which conditions international organizations may confer a ‘nationality’ on means of transportation, examining the law of the sea conventions and air and space treaties. The book finally explores several questions relating to international registration of means of transportation, building a regime of international registration. Vincent Cogliati-Bantz introduces a necessary distinction between transport internationally registered and transport registered in a State but fulfilling a mission for an international organization. As a work that proposes the ability for international organisations to access international spaces without reliance on State-registered means of transport, this book will be of great use and interest to scholars and students of public international law, international organisations, and maritime, space, and aviation law.

Book The Aircraft Commander in Commercial Air Transportation

Download or read book The Aircraft Commander in Commercial Air Transportation written by Menno Sjoerd Kamminga and published by Springer. This book was released on 2013-11-22 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: Less than fifty years have elapsed since the first flight of a power-driven aircraft. On December 17, 1903, the Wright brothers made their now historic flights in an aircraft which they had designed and built themselves; at the fourth attempt on that day a distance of 852 feet was covered during a flight which lasted 59 seconds 1. Unparalleled technical advances followed those first hesitant steps, with the result that aviation has developed into a factor influencing practically every field of society I. The complex mechanism of modem commercial aviation can only function through the combined efforts of countless people. The inspiration of aircraft constructors, the insight and perse verance of air pioneers and the conscientious work of the ground personnel all play their part. Among those who share in this joint task, however, the aircraft commander occupies a special place. He finds himself at the head of a small but comparatively isolated community, which may come under different jurisdictions within a short space of time. From a purely academic aspect he is therefore an interesting figure. Moreover, it may also be useful to examine his legal status for more practical reasons. After all, the aircraft commander holds a key position in aviation, as the safety, economy and regularity of the flight often depend on his skill and judgment.

Book Sovereignty and Jurisdiction in Airspace and Outer Space

Download or read book Sovereignty and Jurisdiction in Airspace and Outer Space written by Gbenga Oduntan and published by Routledge. This book was released on 2011-09-12 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sovereignty and jurisdiction are legal doctrines of a complex nature, which have been subject to differing interpretations by scholars in legal literature. The tridimensionality of state territory recognised under customary international law subsists until the present but there are other territories that do not or cannot belong to any state or political entity which also must be accounted for in legal theory. The issues surrounding sovereignty and jurisdiction are likely to become ever more pressing as globalisation, growing pressure on resources and the need for energy and national security become acute, and the resolution of special delimitation disputes seems likely to become a vital question in the twenty-first century. As a result of the fast pace of technological developments in air and space activities and the massive increases in air transportation , satellite communications and space exploration, the need for scholars and practitioners to sharpen their appreciation of the legal and political issues becomes crucial. This book will focus primarily on the issues of sovereignty jurisdiction and control in airspace and outer space and their effects on public and private activities, but it will also look at related issues pertaining to the Seas and Antarctica. Commercial exploitation, resource control and the international regime regulating contractual obligations in relation to transportation of goods and services over all forms of territory will be examined to the extent that they are necessary to explain jurisdictional rights and duties over territory. Older problems of international law such as crimes in the air and airspace trespass are treated along with newer developments such as space tourism as well as growing demand for private ownership and involvement in outer space exploitation. The book goes on to consider the distinction between airspace and outer space and puts forward legal criteria which would allow for the resolution of the spatial delimitation dispute. These criteria would determine where in spatial terms the exclusive sovereignty of airspace ends and where outer space – the province of all mankind – begins, and contribute to the jurisprudence of territorial sovereignty and jurisdiction.

The Rotterdam Rules: A Practical Annotation examines the text of the Rules, all ninety-six articles of the new Convention, and compares them to the text of the Hague-Visby Rules, the instrument currently covering most bills of lading. The authors have also examined the judgments in cases decided in the English Courts under the Carriage of Goods by Sea Acts of 1971 and 1992 and have indicated whether these cases would be decided differently under the new Rotterdam Rules.
