Book excerpt: Contrary to traditional theories of statutory interpretation, which ground statutes in the original legislative text or intent, legal scholar William Eskridge argues that statutory interpretation changes in response to new political alignments, new interpreters, and new ideologies. It does so, first of all, because it involves richer authoritative texts than does either common law or constitutional interpretation: statutes are often complex and have a detailed legislative history. Second, Congress can, and often does, rewrite statutes when it disagrees with their interpretations; and agencies and courts attend to current as well as historical congressional preferences when they interpret statutes. Third, since statutory interpretation is as much agency-centered as judgecentered and since agency executives see their creativity as more legitimate than judges see theirs, statutory interpretation in the modern regulatory state is particularly dynamic. Eskridge also considers how different normative theories of jurisprudence--liberal, legal process, and antiliberal--inform debates about statutory interpretation. He explores what theory of statutory interpretation--if any--is required by the rule of law or by democratic theory. Finally, he provides an analytical and jurisprudential history of important debates on statutory interpretation.

Chapter 1 introduces the notion of dynamic semantics and discusses in detail the phenomena that have been used to motivate it, such as "donkey" sentences and adverbs of quantification. The second chapter explores in greater depth the interpretation of indefinites and issues related to presuppositions of uniqueness and the "E-type strategy." In Chapter 3, Chierchia extends the dynamic approach to the domain of syntactic theory, considering a range of empirical problems that includes backwards anaphora, reconstruction effects, and weak crossover. The final chapter develops the formal system of dynamic semantics to deal with central issues of definites and presupposition. Chierchia shows that an approach based on a principled enrichment of the mechanisms dealing with meaning is to be preferred on empirical grounds over approaches that depend on an enrichment of the syntactic apparatus. Interdisciplinary work appears overly abstract and methodologically restrictive, with little room for systematic theologians self-consciously operating within a particular historical tradition. In Interdisciplinary Interpretation: Paul Ricoeur and the Hermeneutics of Theology and Science,Kenneth A. Reynhout seeks to address this concern by constructing an alternative understanding of interdisciplinary theology based on the hermeneutical thought of Paul Ricoeur, generally recognized as one of the most interdisciplinary philosophers of the twentieth century. Appealing to Ricoeur’s view of interpretation as the dialectical process of understanding through explanation, Reynhout argues that theology’s engagement with the natural sciences is fundamentally hermeneutical in character. As such, interdisciplinary theologians can faithfully borrow meaning from the sciences through a process of “interdisciplinary interpretation,” a process that can honestly attend to the legitimate challenges posed by the natural sciences without automatically requiring the evacuation of theological norms and convictions. Reynhout’s creative appropriation of Ricoeur’s hermeneutics succeeds in providing a novel interdisciplinary vision, not only for theology but also for interdisciplinary work in general.

Book excerpt: Performance studies in the Western art music tradition have often been dominated by the relationship of theoretical score-analysis to performance, although some recent trends have aimed at dislodging the primacy of the score in favour of assessing performance on its own terms. In this book Julian Hellaby further develops these trends by placing performance firmly at the heart of his investigations and presents a structured approach to analysing the interpretation of a musical work from the perspective of a musically informed listener. To enable analysis of individual interpretations, the author develops a conceptual framework in which a series of performance-related categories is arranged hierarchically into an 'interpretative tower'. Using this framework to analyse the acoustic evidence of a recording, interpretative elements are identified and used to assess the relationship between a performance and a work. The viability of the interpretative tower is tested in three major case studies. Contrasting recorded performances of solo keyboard works by Bach, Messiaen and Brahms are the focus of these studies, and analysis of the performances, using the tower model, uncovers an interpretative rationale. The book is wide-ranging in scope and holistic in approach, offering a means of enhancing a listener's appreciation of an interpretation. It is richly illustrated with examples taken from commercial recordings and from the author's own recordings of the three focal works. A CD of the latter is included.

In this thought-provoking book, Jerry Mashaw stakes out a middle ground between those who champion public choice theory (the application of the conventional methodology of economics to political science matters, also known as rational choice theory) and those who disparage it. He argues that in many cases public choice theory's reach has exceeded its grasp. In others, public choice insights have not been pursued far enough by those who are concerned with the operation and improvement of legal institutions. While Mashaw addresses perennial questions of constitutional law, legislative interpretation, administrative law, and the design of public institutions, he arrives at innovative conclusions. Countering the positions of key public choice theorists, Mashaw finds public choice approaches virtually useless as an aid to the interpretation of statutes, and he finds public choice arguments against delegating political decisions to administrators incoherent. But, using the tools of public choice analysts, he reverses the lawyers' conventional wisdom by arguing that substantive rationality review is not only legitimate but a lesser invasion of legislative prerogatives than much judicial interpretation of statutes. And, criticizing three decades of "law reform," Mashaw contends that pre-enforcement judicial review of agency rules has seriously undermined both governmental capacity and the rule of law.
