Download or read book Modern Studies in Property Law Volume 10 written by Ben McFarlane and published by Bloomsbury Publishing. This book was released on 2019-05-30 with total page 461 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contains a collection of papers presented at the Twelfth Biennial Modern Studies in Property Law Conference held at University College London in April 2018. The conference and its published proceedings are an established forum for property lawyers from around the world to showcase the latest research. This collection includes a keynote address by Dame Elizabeth Gloster, former Vice President of the Court of Appeal (Civil Division), on technology in property law. It also includes plenary addresses by Professor Henry Smith on the architecture of property law and the challenge of compiling the American Law Institute's Fourth Restatement of Property, and by Her Honour Judge Karen Walden-Smith on the role of the first instance judge in property cases. Sixteen further chapters address a wide range of issues, including the theory and taxonomy of land law, the re-evaluation of land obligations, the nature and operation of equitable property rights and shares, the role of property in commerce, comparative approaches to leases and trusts, and contemporary issues in land registration. Collectively, the chapters demonstrate the vibrancy, diversity and importance of property law and of current research in the subject.

Book A Practical Guide to the Land Transfer ACT

Available in PDF, EPUB and Kindle. Book excerpt: The Land Transfer Act is at the heart of conveyancing law and practice, a field in which many lawyers - both specialist and generalist - work. This book is a rapid-response, practical guide to the important changes to New Zealand property law coming in with the new Land Transfer Act. The Land Transfer Act also deals with a range of more complex issues, such as mortgages, easements, covenants, and subdivisions. It is essential that practitioners have a strong understanding of Land Transfer legislation. A Practical Guide to the Land Transfer Act is the first text on the Act, which marks a big and important change to the land transfer system in New Zealand, and will include a precis of the legislation, as well as commentary on key issues. As such, it will be a first port of call for practitioners and students wanting to understand the legislation, and grapple with its principles, contents, and wording. It is an essential text for lawyers, legal executives, LINZ officers, and for students and academics.

Download or read book Sale of Land written by Donald William McMorland and published by . This book was released on 2011 with total page 673 pages. Available in PDF, EPUB and Kindle. Book excerpt: The aim of the book is to provide an account of the law of New Zealand relating to the sale of land. Such a contract is governed by the general law of contract, as is any other contract whatever its subject matter. The author has endeavoured to state the law in this book within a reasonable compass while including some discussion of the major subject areas which commonly arise. This is a matter of balance and individual judgment and others may disagree with the decisions I have made. Some areas of contract law, though applicable, arise infrequently in the present context and the law which applies is both no different from that applicable to any other form of contract and is fully discussed elsewhere in the New Zealand literature. On that basis, this book does not discuss areas such as illegality or mistake. Other matters, though also of general application, arise more frequently; in those cases, though there is full discussion elsewhere, the author thought it desirable to set out, albeit briefly, the principal tenets of the area. This accounts for the treatment of such matters as agency, misrepresentation, contract formation, and aspects of remedies. Other matters, such as title or settlement, are particular to this form of contact and require full discussion.
