Book Max Weber s Interpretive Sociology of Law

Download or read book Max Weber s Interpretive Sociology of Law written by Michel Coutu and published by Routledge. This book was released on 2018-04-09 with total page 515 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents a clear and precise account of the structure and content of Max Weber's sociology of law: situating its methodological and epistemological specificity in relation to other approaches to the sociology of law; as well as offering a critical evaluation of Weber's usefulness for contemporary socio-legal research. The book is divided into three parts. The first part deals with the methodological foundations of Weber's sociology of law. The second analyses the central theme of this sociology, the rationalisation of law, from the perspective of its internal logical coherence, its empirical validity, and finally its legitimacy. The third part questions the present-day relevance of the Weberian sociology of law for socio-legal research, notably with regard to legal pluralism. Max Weber, it is demonstrated, is not merely a 'founding father' of the sociology of law; rather, his methodology, concepts, and empirical analyses remain highly useful to the further development of work in this area.

Book The Reconstruction of the Juridico Political

Download or read book The Reconstruction of the Juridico Political written by Ian Bryan and published by Routledge. This book was released on 2015-12-22 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: Hans Kelsen and Max Weber are conventionally understood as the original proponents of two distinct and opposed processes of concept formation generating two separate and contrasting theoretical frameworks for the study of law. The Reconstruction of the Juridico-Political: Affinity and Divergence in Hans Kelsen and Max Weber contests the conventional understanding of the theoretical relationship between Kelsen’s legal positivism and Weber’s sociology of law. Utilising the conceptual frame of the juridico-political, the contributors to this interdisciplinary volume analyse central points of affinity and divergence in the work of these two influential figures. Thus, the chapters collected in The Reconstruction of the Juridico-Political offer a comprehensive reconsideration of these affinities and divergences, through a comparison of their respective reconstruction of the notions of democracy, the State, legal rights and the character of law. From this reconsideration a more complex understanding of their theoretical relationship emerges combined with a renewed emphasis upon the continued contemporary relevance of the work of Kelsen and Weber.

Book Les diff rends territoriaux devant le juge international

Download or read book Les diff rends territoriaux devant le juge international written by Géraldine Giraudeau and published by Martinus Nijhoff Publishers. This book was released on 2012-12-03 with total page 557 pages. Available in PDF, EPUB and Kindle. Book excerpt: Arbitral and judicial decisions dealing with territorial land and maritime disputes bear the mark of compromising. They draw boundaries situated between the respective pretentions of the parties and ensure an equitable share of spaces and resources. This phenomenon of compromising symptomatically appears in the jurisprudence dealing with territorial disputes, because of their specific nature, and the geostrategic, economic and emotional factors at stake. It is also due to the remarkable flexibility of applicable norms and principles, which provides a vast power of appreciation to the judge. This study enhances how the content of the decisions is used in order to reach a balanced solution and demonstrates that the international judge focuses on peacekeeping considerations.

Book Objectivity in Law and Legal Reasoning

Download or read book Objectivity in Law and Legal Reasoning written by Jaakko Husa and published by Bloomsbury Publishing. This book was released on 2013-01-28 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal theorists consider their discipline as an objective endeavour in line with other fields of science. Objectivity in science is generally regarded as a fundamental condition, informing how science should be practised and how truths may be found. Objective scientists venture to uncover empirical truths about the world and ought to eliminate personal biases, prior commitments and emotional involvement. However, legal theorists are inevitably bound up with a given legal culture. Consequently, their scholarly work derives at least in part from this environment and their subtle interaction with it. This book questions critically, in novel ways and from various perspectives, the possibilities of objectivity of legal theory in the twenty-first century. It transpires that legal theory is unavoidably confronted with varying conceptions of law, underlying ideologies, approaches to legal method, argumentation and discourse etc, which limit the possibilities of 'objectivity' in law and in legal reasoning. The authors of this book reveal some of these underlying notions and discuss their consequences for legal theory.

Book The Challenge of Carl Schmitt

Book excerpt: Carl Schmitt's thought serves as a warning against the dangers of complacency entailed by triumphant liberalism. His conception of politics is a sharp challenge to those who believe that there is a third way between the left and right and that the increasing moralization of political discourse constitutes a great advance for democracy. Schmitt reminds us forcefully that the essence of politics is struggle and that the distinction between friend and enemy cannot be abolished. Contributions: Gregoris Ananiadis, Agostino Carrino, Catherine Colliot-Thélène, Jorge Dotti, David Dyzenhaus, Paul Hirst, Jean-François Kervégan, Chantal Mouffe, Ulrich Preuss, Slavoj Zizek and an important essay by Carl Schmitt available in English for the first time.

Available in PDF, EPUB and Kindle.

Book The Political Anatomy of Domination

Download or read book The Political Anatomy of Domination written by Béatrice Hibou and published by Springer. This book was released on 2017-03-22 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: Rereading Marx, Weber, Gramsci and, more recently, Foucault, Béatrice Hibou tackles one of the core questions of political and social theory: state domination. Combining comparative analyses of everyday life and economics, she highlights the arrangements, understandings and practices that make domination conceivable, bearable, even acceptable or reassuring. To carry out this demonstration, Hibou examines authoritarian situations—especially comparing the paradigmatic European cases of fascism, Nazism and Soviet socialism and those of contemporary China or North and Sub-Saharan Africa.
