Collins presents the first comprehensive history of martial law in the early modern period. He argues that rather than being a state of exception from law, martial law was understood and practiced as one of the King's laws. Further, it was a vital component of both England's domestic and imperial legal order. It was used to quell rebellions during the Reformation, to subdue Ireland, to regulate English plantations like Jamestown, to punish spies and traitors in the English Civil War, and to build forts on Jamaica. Through outlining the history of martial law, Collins reinterprets English legal culture as dynamic, politicized, and creative, where jurists were inspired by past practices to generate new law rather than being restrained by it. This work asks that legal history once again be re-integrated into the cultural and political histories of early modern England and its empire.

Using the voluminous radical literature of the period, Joseph Scalice reveals how two parties, the PKP and the CPP, torn apart by the Sino-Soviet dispute, subordinated the explosive mass struggles of the time behind rival elite conspirators. The PKP backed Marcos and the CPP, his bourgeois opponents. The absence of an independent mass movement in defense of democracy made dictatorship possible. The Drama of Dictatorship argues that the martial law regime was not fundamentally the outcome of Marcos's personal quest to remain in power but rather a consensus of the country's ruling elite, confronted with mounting social unrest, that authoritarian forms of rule were necessary to preserve their property and privileges. The bourgeois opponents of Marcos did not defend democracy but, like Marcos, plotted against it.

Book excerpt: In Securing Paradise, Vernadette Vicuña Gonzalez shows how tourism and militarism have functioned together in Hawai`i and the Philippines, jointly empowering the United States to assert its geostrategic and economic interests in the Pacific. She does so by interpreting fiction, closely examining colonial and military construction projects, and delving into present-day tourist practices, spaces, and narratives. For instance, in both Hawai`i and the Philippines, U.S. military modes of mobility, control, and surveillance enable scenic tourist byways. Past and present U.S. military posts, such as the Clark and Subic Bases and the Pearl Harbor complex, have been reincarnated as destinations for tourists interested in World War II. The history of the U.S. military is foundational to tourist itineraries and imaginations in such sites. At the same time, U.S. military dominance is reinforced by the logics and practices of mobility and consumption underlying modern tourism. Working in tandem, militarism and tourism produce gendered structures of feeling and formations of knowledge. These become routinized into everyday life in Hawai`i and the Philippines, inculcating U.S. imperialism in the Pacific.

Book excerpt: Selected as a 2017 CHOICE Outstanding Academic Title Bayonets in Paradise recounts the extraordinary story of how the army imposed rigid and absolute control on the total population of Hawaii during World War II. Declared immediately after the Pearl Harbor attack, martial law was all-inclusive, bringing under army rule every aspect of the Territory of Hawaii's laws and governmental institutions. Even the judiciary was placed under direct subservience to the military authorities. The result was a protracted crisis in civil liberties, as the army subjected more than 400,000 civilians—citizens and alien residents alike—to sweeping, intrusive social and economic regulations and to enforcement of army orders in provost courts with no semblance of due process. In addition, the army enforced special regulations against Hawaii's large population of Japanese ancestry; thousands of Japanese Americans were investigated, hundreds were arrested, and some 2,000 were incarcerated. In marked contrast to the well-known policy of the mass removals on the West Coast, however, Hawaii's policy was one of "selective," albeit preventive, detention. Army rule in Hawaii lasted until late 1944—making it the longest period in which an American civilian population has ever been governed under martial law. The army brass invoked the imperatives of security and "military necessity" to perpetuate its regime of censorship, curfews, forced work assignments, and arbitrary "justice" in the military courts. Broadly accepted at first, these policies led in time to dramatic clashes over the wisdom and constitutionality of martial law, involving the president, his top Cabinet officials, and the military. The authors also provide a rich analysis of the legal challenges to martial law that culminated in Duncan v. Kahanamoku, a remarkable case in which the U.S. Supreme Court finally heard argument on the martial law regime—and ruled in 1946 that provost court justice and the military's usurpation of the civilian government had been illegal. Based largely on archival sources, this comprehensive, authoritative study places the long-neglected and largely unknown history of martial law in Hawaii in the larger context of America's ongoing struggle between the defense of constitutional liberties and the exercise of emergency powers.

At the beginning of the rebellion, state governors in Ohio, Indiana, and Illinois cooperated with federal law enforcement officials in various attempts—all failed—to investigate reports of secret groups and individuals who opposed the Union war effort. Starting in 1862, army commanders took it upon themselves to initiate investigations of antiwar sentiment in those states. By 1863, several of them had established intelligence operations staffed by hired civilian detectives and by soldiers detailed from their units to chase down deserters and draft dodgers, to maintain surveillance on suspected persons and groups, and to investigate organized resistance to the draft. By 1864, these spies had infiltrated secret organizations that, sometimes in collaboration with Confederate rebels, aimed to subvert the war effort. Stephen E. Towne is the first to thoroughly explore the role and impact of Union spies against Confederate plots in the North. This new analysis invites historians to delve more deeply into the fabric of the Northern wartime experience and reinterpret the period based on broader archival evidence.
