Excerpt: ...bill must be filed within one year after the marriage. The property so forfeited is to go to the innocent party. The statute declares, where persons knowingly and wilfully marry in any place other than a church or public chapel wherein banns may be published, without a special license, or shall knowingly marry without due publication of banns or the obtaining of a license from the proper authorities, or acquiesce in the solemnization of the marriage by one not in orders, the marriage shall be null and void to all intents and purposes whatsoever. The clause of Statute 26 George II, that no suit shall lie in an ecclesiastical court for the purpose of compelling a marriage in fade ecclesiae, by reason of any promise per verba de praesenti or per verba de futuro, was re-enacted. There are also numerous provisions relating to the registration of marriages by the persons competent to solemnize them. The statute exempts Quakers and Jews from its operation. All these acts, be it remembered, refer to England only. The next Act relating to marriage is that of 6 & 7, William IY., Chap. 85 (1836). This law marks an epoch in the history of English marriage legislation. It was felt that something must be done to permit dissenters to marry according to their own fashion. Even to the clergymen of the Established Church there was something unpleasant in being compelled to unite people by means of forms and ceremonies for which they had not the slightest reverence. Lord John Russell introduced the bill, the object of which, he said, was to permit every one to be married according to whatever form his conscience dictated. Book excerpt: Those who have sought information on the extent of divorce in the modern world will know that the most accessible sources lie in international yearbooks, (1) and that from these it is possible to make certain broad comparisons of a historical or geographical kind. For anyone country, for instance, changes in the divorce rate can be traced, or comparative rates for any number of countries at any given time can be examined. Similarly, it is possible to discover differences and similarities in divorce trends on an international basis, either for individual nations or for region al or cultural clusters. Typically, however, such sources cannot be used for detailed or sophisticated comparisons because of the limit ed volume of data, and of the nature of the statistics presented. To detect detailed differences in divorce-propensity by time or place, for instance, ideally requires cohort data, information on the number of marriages dissolved by divorce within one, two---x years among every 1,000 or 10,000 of marriages contracted in a given year. Such data do not appear in the international statistical summaries, which often do not even use the next best kind of measure, namely divorces per 1,000 or 10,000 existing marriages. Often the figures given are those for divorces per thousand of tot a I population, and these are of little comparative value because of variations in popu lation structure.

Although in the past law reform was slow, since 1969 the impetus for reform has gathered momentum. It is no exaggeration to say that the changes that have occurred in Europe in the last six or seven years have radically altered the very concept of the family in Europe. As a distinguished scholar and former editor of the Family Law volume of the International Encyclopaedia of Com parative Law, Professor Max Rheinstein, has put it: 'These transformations are not fully completed anywhere. They have gone farthest in the countries of highest industrialization and in those of socialist rule. But they have set in wherever industrialization has obtained a foothold. The degree of 'modernization' offamily law may indeed be used as an index of a society's degree of Westernization. 'l Yet, such is the force of traditional patterns of thought that, although we are aware of distinct changes in various legal systems, the underlying and implied assumption is that family law can still move within the traditional framework. This is not surprising for, until comparatively recently at least family law was not thought of as a suitable subject of unification. It was claimed that there is a peculiar and distinct element which derives from the mores and innermost beliefs of each people, from a sort of family Volksgeist that renders impossible the approximation or unification of family law.

The main objective of this conference was to instigate an in-depth discussion regarding various facets of the convergence/divergence discord. Another objective was to give scholars the opportunity to present their respective views in the ongoing debate surrounding convergence, divergence and deliberate harmonisation activities in the field of family law. In the first part of this book the historical and theoretical issues of the convergence/divergence debate and the controversy surrounding the "cultural constraints" argument are discussed. The second part gives a picture of the contemporary role of convergence/divergence tendencies on a regional level in various parts of Europe. It starts with an overview of the recent trends in the renowned "Nordic co-operation" in the approximation of family laws, which is generally considered to be the most successful example of regional harmonisation of family laws in Europe. The next article deals with convergence/divergence tendencies in the development of the family law of the Spanish autonomous communities. The following two contributions offer a summary of the convergence and divergence trends in Eastern Europe against the background of such sweeping events as the fall of the Soviet Union, the disintegration of the Eastern block and the accession of a majority of the Central European countries to the EU.
