Elle confère au titulaire un droit exclusif sur un signe, non seulement aux fins de distinction de ses produits mais aussi de se protéger de ses concurrents. A raison de sa nature, la marque n’est donc pas vouée à protéger le consommateur, entendu comme une « personne physique ou morale qui se procure ou qui utilise un bien ou un service pour un usage non professionnel », contre le professionnel. Au contraire, le droit de marque affecte le jeu de la concurrence donc l’intérêt des consommateurs, à l’égard desquels la concurrence est globalement favorable. Toutefois, l'influence du consommateur sur le droit des marques est croissante. Au gré de ses décisions, la Cour de Justice des Communautés Européennes a en effet imposé la fonction de garantie d'identité d'origine profitant au consommateur comme la fonction essentielle du droit des marques. La portée du droit de marque lui étant liée, le consommateur est devenu en son sein incontournable et omniprésent. Le droit des marques n'en est pas pour autant devenu un droit consumériste au sens strict du terme puisqu’il accorde à la notion de consommateur une dimension économique. En matière de marques, la notion recouvre indifféremment des personnes agissant pour leurs besoins personnels et professionnels. Cette présence révélée, encore faut-il préciser l’étendue et les différentes formes de sa manifestation. L’analyse consumériste du droit de marque conduit à s'interroger à la fois sur l’existence d’une influence réciproque ou unilatérale du consommateur sur le droit de marque et sur l’éventuelle protection que le consommateur peut en retirer.

But there are huge problems in the 'post-revolutionary' era: farmers with small or marginal holdings have benefited less than wealthier farmers; intensive mono-cropping has made production more susceptible to environmental stresses and shocks. Now there is evidence of diminishing returns from intensive and intensively chemical agricultural production. What is needed is a new approach, equally revolutionary, but different in its ideas and style. The authors set out what they mean by 'sustainable' agriculture in the new era and look at the effects of international economic restraints and of national policies on the kind of development they see as necessary. They chart a path for sustainable livelihoods for Third World farmers enmeshed by forces outside their control. They describe methods of evaluating and resolving the tough trade-offs all levels of intervention, from international trade down to the individual farm. This book cannot provide all the answers, but it does indicate what international conditions we need to be aware of, what national policies we need to advocate and what approaches at the local level we need to adopt to ensure the goal of agricultural sustainability.
