Updated as of May 29, 2018 The Coast Guard is amending the monetary property damage threshold amounts for reporting a marine casualty and for reporting a type of marine casualty called a "serious marine incident." The original regulations that set these dollar threshold amounts were written in the 1980s and have not been updated since that time. Because the monetary thresholds for reporting have not kept pace with inflation, vessel owners and operators have been required to report relatively minor casualties. Additionally, the original regulations require mandatory drug and alcohol testing following a serious marine incident. As a result, vessel owners and operators are conducting testing for casualties that are less significant than those intended to be captured by the original regulations. Updating the original regulations will reduce the burden on vessel owners and operators, and will also reduce the amount of Coast Guard resources expended to investigate these incidents. This report found that the USCG does not have adequate processes to investigate, take corrective actions, and enforce Federal regulations related to the reporting of marine accidents. That is because the USCG has not developed and retained sufficient personnel, established a complete process with dedicated resources to address corrective actions, and provided adequate training to personnel on enforcement of marine accident reporting. As a result, the USCG may be delayed in identifying the causes of accidents; initiating corrective actions; and providing the findings and lessons learned to mariners, the public, and other government entities. As oil and gas, shipping, and tourism activities increase, the possibilities of an oil spill also increase. How can we best prepare to respond to such an event in this challenging environment? Responding to Oil Spills in the U.S. Arctic Marine Environment reviews the current state of the science regarding oil spill response and environmental assessment in the Arctic region north of the Bering Strait, with emphasis on the potential impacts in U.S. waters. This report describes the unique ecosystems and environment of the Arctic and makes recommendations to provide an effective response effort in these challenging conditions. Book excerpt: Whether the result of an oil well blowout, vessel collision or grounding, leaking pipeline, or other incident at sea, each marine oil spill will present unique circumstances and challenges. The oil type and properties, location, time of year, duration of spill, water depth, environmental conditions, affected biomes, potential human community impact, and available resources may vary significantly. Also, each spill may be governed by policy guidelines, such as those set forth in the National Response Plan, Regional Response Plans, or Area Contingency Plans. To respond effectively to the specific conditions presented during an oil spill, spill responders have used a variety of response optionsâ€"including mechanical recovery of oil using skimmers and booms, in situ burning of oil, monitored natural attenuation of oil, and dispersion of oil by chemical dispersants. Because each response method has advantages and disadvantages, it is important to understand specific scenarios where a net benefit may be achieved by using a particular tool or combination of tools. This report builds on two previous National Research Council reports on dispersant use to provide a current understanding of the state of science and to inform future marine oil spill response operations. The response to the 2010 Deepwater Horizon spill included an unprecedented use of dispersants via both surface application and subsea injection. The magnitude of the spill stimulated interest and funding for research on oil spill response, and dispersant use in particular. This study assesses the effects and efficacy of dispersants as an oil spill response tool and evaluates trade-offs associated with dispersant use.

This rule, which includes provisions covering specific electrical and machinery requirements for new and existing towing vessels, the use and approval of third-party organizations, and procedures for obtaining Certificates of Inspection, will become effective July 20, 2016. Book excerpt: 07 October 2019 The Notice of Violation (NOV) program was implemented in 1995 to address the Coast Guard's concern that the civil penalty assessment process was too lengthy when applied to small oil discharges under 100 gallons and minor pollution prevention regulation violations (33 CFR parts 154, 155, and 156). The process time meant that a party frequently would have additional violations before being notified of an initial violation. Early resolution of these minor violations saved time and reduced costs of internal reviews, improved compliance and deterrence, and facilitated corrective action by providing more immediate notice to the charged party. Because of the success of the initial limited NOV program, it was expanded in 2004 to include oil spills of 1,000 gallons or less and to include violations of other laws and regulations that the Coast Guard enforces. Since its inception, the NOV program modified the civil penalty process by creating a regulation, 33 CFR 1.07- 11, that allowed for immediate notification to the responsible party of the alleged violation(s).

Book excerpt: "Forging a Total Force traces the evolution of the Guard and reserve from the Revolutionary War-era militias to today's operational reserve, an integral part of the nation's total force. In the early republic, the ideal of a citizen-solider, capable of taking the field with little or no training, predominated. The realities of modern combat slowly made it clear that a more professional force was required, but policy changes failed to keep up with that changing necessity. The nation struggled to provide adequate training and equipment to the reserve component throughout the Cold War until the idea of a Total Force, which integrated regular and reserve components, emerged and was achieved. It wasn't until the defense buildup of the 1980s that the ideal of a combat-ready reserve became reality. The core of this book focuses on what came next, from 1990 to 2011, with particular emphasis on the decade after 9/11. The Persian Gulf War demonstrated both the effectiveness of the reserve and the challenges it continued to face. The post-Cold War drawdown during the 1990s made the smaller active component more dependent on the reserves than it had been since the nation's founding. The reserve component proved itself yet again in the wars following 9/11, but also became strained as it became clear just how much the nation depended on its Guard and reserve. Finally, the authors detail the policy changes made midstream in an attempt to address issues with the overextended force, such as balancing training and deployment with civilian lives and careers, providing health care to reservists, and integrating the active and reserve components. Or did the company, the Coast Guard and the American Bureau of Shipping all have a hand on the helm of the SS El Faro as she steered too close to Hurricane Joaquin? This is an examination of a tragedy that has been well-researched and investigated -- heroically so at times -- by the United States Coast Guard and the National Transportation Safety Board. Three very well-done books have been published. All of these efforts produced detailed recommendations and observations and all are publicly available. I commend them to you. My effort touches on the broad sweep and events of the tragedy and investigation, but if you want the detailed story of the final voyage of the ship, you're better off with the other books. My main goal here is to show how the SS El Faro fit into a larger system and culture -- one that I have been covering off and on as a journalist and author for 38 years. It's this system, I feel, that will result in another SS El Faro someday unless it is reformed. Another note on style. My preference in non-fiction is "narrative." In other words, whenever I can, I tell a story and show what is happening; I prefer that to "telling" the reader, because I think "showing" is more readily absorbed. Humans learn through stories. Story telling rather than a lecture better illustrates the emotions at play here, as well as the moods, culture and vibe of the ship and the industry. This does not mean I take a pure poetic license. The dialogue quoted here is real, not made up. The material is factual.
