Download or read book Convention for the Unification of Certain Rules for International Carriage by Air Done at Montreal on 28 May 1999 Montreal Convention of 1999 written by Elmar Giemulla and published by Kluwer Law International B.V.. This book was released on 2022-09-23 with total page 894 pages. Available in PDF, EPUB and Kindle. Book excerpt: After decades of controversy, a unified liability system for international carriage by air was established by the Montreal Convention of 1999, which went into force in November 2003. The new convention replaced the legal labyrinth created by the numerous perplexing accretions that had attached themselves to the Warsaw Convention. In this indispensable volume, air law professionals will find the full English text of the Convention with detailed article-by-article annotation, including all developments to date in case law, legal literature, national and international legislation, and administrative law. The commentary covers ongoing developments in such crucial aspects as the following: applicability of the Convention; documents for carriage; liability for death or injury of passengers; liability for damages to baggage and cargo and for delay; exoneration from liability; carriage involving a contractual and an actual carrier; time limits for filing a claim and forfeiture; jurisdiction; exclusivity of the Convention versus applicability of national law; and insurance issues. In addition to the article-by-article annotation, the book features such useful information as a synopsis comparing the Warsaw and Montreal Conventions, IATA Conditions and Resolutions, relevant European Union Regulations, and a list of the contracting parties to the Convention. Given that the Montreal Convention’s application during its first 20 years has already documented a promising and forceful new beginning in the complex area of air transport liability, this incomparable research tool will provide an enormous wealth of information and guidance for anyone who deals with legal issues arising from civil air law, including lawyers, policymakers, insurers and academics.

Book To Form A More Perfect Union

Download or read book To Form A More Perfect Union written by Robert A. McGuire and published by Oxford University Press. This book was released on 2003-03-27 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many important questions regarding the creation and adoption of the United States Constitution remain unresolved. Did slaveholdings or financial holdings significantly influence our Founding Fathers' stance on particular clauses or rules contained in the Constitution? Was there a division of support for the Constitution related to religious beliefs or ethnicity? Were founders from less commercial areas more likely to oppose the Constitution? To Form a More Perfect Union successfully answers these questions and offers an economic explanation for the behavior of our Founding Fathers during the nation's constitutional founding. In 1913, American historian Charles A. Beard controversially argued in his book An Economic Interpretation of the Constitution of the United States that the framers and ratifiers of the Constitution were less interested in furthering democratic principles than in advancing specific economic and financial interests. Beard's thesis eventually emerged as the standard historical interpretation and remained so until the 1950s. Since then, many constitutional and historical scholars have questioned an economic interpretation of the Constitution as being too narrow or too calculating, believing the great principles and political philosophies that motivated the Founding Fathers to be worthier subjects of study. In this meticulously researched reexamination of the drafting and ratification of our nation's Constitution, Robert McGuire argues that Alexander Hamilton, James Madison, George Mason and the other Founding Fathers did act as much for economic motives as for abstract ideals. To Form a More Perfect Union offers compelling evidence showing that the economic, financial, and other interests of the founders can account for the specific design and adoption of our Constitution. This is the first book to provide modern evidence that substantiates many of the overall conclusions found in Charles Beard's An Economic Interpretation while challenging and overturning other of Beard's specific findings. To Form a More Perfect Union presents an entirely new approach to the study of the shaping of the U.S. Constitution. Through the application of economic thinking and rigorous statistical techniques, as well as the processing of vast amounts of data on the economic interests and personal characteristics of the Founding Fathers, McGuire convincingly demonstrates that an economic interpretation of the Constitution is valid. Radically challenging the prevailing views of most historians, political scientists, and legal scholars, To Form a More Perfect Union provides a wealth of new findings about the Founding Fathers' constitutional choices and sheds new light on the motivations behind the design and adoption of the United States Constitution.

Download or read book Principles of International Criminal Law written by Gerhard Werle and published by OUP Oxford. This book was released on 2014-08-14 with total page 787 pages. Available in PDF, EPUB and Kindle. Book excerpt: Principles of International Criminal Law has become one of the most influential textbooks in the field of international criminal justice. It offers a systematic and comprehensive analysis of the foundations and general principles of substantive international criminal law, including thorough discussion of its core crimes. It provides a detailed understanding of the general principles, sources, and evolution of international criminal law, demonstrating how it has developed, and how its application has changed. After establishing the general principles, the book assesses the four key international crimes as defined by the statute of the International Criminal Court: genocide, crimes against humanity, war crimes, and the crime of aggression. This new edition revises and updates work with developments in international criminal justice since 2009. It includes new material on the principle of culpability as one of the fundamental principles of international criminal law, the notion of terrorism as a crime under international law, the concept of direct participation in hostilities, the problem of so-called unlawful combatants, and the issue of targeted killings. The book retains its highly-acclaimed systematic approach and consistent methodology, making the book essential reading for both students and scholars of international criminal law, as well as for practitioners and judges working in the field.
