Book excerpt: Fin dagli esordi delle nostre attività didattiche abbiamo avvertito la necessità di porre i discenti del corso istituzionale di diritto privato romano in diretto contatto con le testimonianze del pensiero giuridico romano al fine di documentare e, soprattutto, di mostrare nella loro applicazione concreta le idee esposte durante le lezioni o illustrate con più meditata e precisa intonazione nei manuali di riferimento. Tale attività di supporto, praticata all’inizio in modo del tutto “artigianale”, prima con fotocopie poi caricando sul web i materiali, si è consolidata nel tempo in virtù anche delle conferme che ci sono giunte della sua efficacia presso gli studenti sotto il profilo didattico e trova finalmente in questo volumetto una veste editoriale più consona e formalmente curata. Limiti precisi sono stati posti a questa breve antologia di fonti. Il primo è di ordine cronologico: i testi sono attinenti pressoché esclusivamente al diritto classico e anche le poche citazioni tratte dalle Istituzioni di Giustiniano riguardano problemi e prospettive emerse in quel periodo, poiché i corsi istituzionali da noi impartiti si concentrano per gran parte sul diritto privato di età preclassica e classica. Il secondo è di natura tematica: la collezione delle fonti è circoscritta all’editto del pretore e alla giurisprudenza, di cui si sono cercate di illustrare in una prima parte generale le tecniche e i modi di formazione del ius, e, poi, in una più ampia parte speciale, le ricadute casistiche su un nucleo di figure e istituti del ius privatum. Questa scelta trova giustificazione nella convinzione di porre in risalto il peculiare carattere del diritto romano classico inteso come “sistema giuridico aperto”. Il diritto privato romano nel suo impianto classico della tarda Repubblica e del principato, infatti, fu un diritto principalmente costruito sulle concessioni di specifiche azioni processuali da parte degli organi magistratuali e sulle soluzioni di casi da parte dei giuristi. Un modello che – come per altri versi il Case law method anglosassone – si pone quasi in antitesi rispetto ai “sistemi giuridici chiusi” dell’odierna Europa continentale, fra cui ovviamente quello italiano, incentrati tendenzialmente su una struttura gerarchica ed espressa di norme, fissata e modificabile solo attraverso i meccanismi preposti dall’autorità statuale e che trovano nell’idea di codice la loro massima evidenza. Il terzo limite è squisitamente legato alla funzione didattica della presente antologia. La casistica giurisprudenziale selezionata attiene ai diritti reali e soprattutto al diritto delle obbligazioni parte del programma che tradizionalmente viene esposta per ultima nell’economia del corso, avendo preferito non allargare tale selezione ad altri settori del diritto privato; ci è parso, infatti, non opportuno avvicinare fin dall’inizio gli studenti all’impostazione per casi che inevitabilmente potrebbe disorientare il discente alle prime armi, attendendo che tale contatto avvenisse in un momento successivo quando si è già acquisita una minima familiarità con le nozioni sostanziali e metodologiche del diritto romano.
