Book Litigating Transnational Human Rights Obligations

Download or read book Litigating Transnational Human Rights Obligations written by Mark Gibney and published by Routledge. This book was released on 2013-10-30 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: Human rights have traditionally been framed in a vertical perspective with the duties of States confined to their own citizens or residents. Obligations beyond this territorial space have been viewed as either being absent or minimalistic at best. However, the territorial paradigm has now been seriously challenged in recent years in part because of the increasing awareness of the ability of States and other actors to impact human rights far from home both positively and negatively. In response to this awareness various legal principles have come into existence setting out some transnational human rights obligations of varying degrees. However, notwithstanding these initiatives, judicial institutions and monitoring bodies continue to show an enormous hesitancy in moving beyond a territorial reading of international human rights law. This book addresses the issue in an innovative and challenging way by crafting legally sound hypothetical "judgments" from a number of adjudicatory fora. The judgments are based on real world situations where extraterritorial or transnational issues have emerged, and draw on existing international human rights law, albeit a progressive interpretation of this law. The book shows that there are a number of judicial and quasi-judicial systems where transnational human rights claims can, and should be enforced. These include: the World Trade Organization; the International Court of Justice; the regional human rights monitoring bodies; domestic courts; and the UN treaty bodies. Each hypothetical judgment is accompanied by detailed commentary placing it in context in order to show how international human rights law can address issues of a transnational character. The book will be of interest to human scholars and lawyers, practitioners, activists and aid officials.

  • Publisher : Nova Biomedical Books
  • Release : 2000
  • ISBN :
  • Pages : 450 pages

Download or read book Human Rights written by Arthur V. Carrington and published by Nova Biomedical Books. This book was released on 2000 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: To the consternation of the haves, some humans continue to insist that they are entitled to live as humans. While it is perhaps a question of philosophy what constitutes a human right, it is more clear what constitutes an abuse of human rights. The world has never been short on abusers and is surely not now. Only the names and faces have changed over time. The powerful tend to be the abusers and the weak the abused. Being aware of the abuses can at least focus light on them and perhaps serve as a proactive response. This bibliography presents hundreds of citations of human right violations under the categories: Basic Human Rights; North America; Latin America; Europe; Asia; Middle East and Africa. Access is provided via Title, Author and Subject Indexes.

Book Scaling Migrant Worker Rights

Download or read book Scaling Migrant Worker Rights written by Xochitl Bada and published by Univ of California Press. This book was released on 2023-01-10 with total page 238 pages. Available in PDF, EPUB and Kindle. Book excerpt: International migrants' home countries often play an integral part in protecting their citizens' labor and human rights abroad. At the same time, institutions such as labor unions, worker centers, and legal aid groups are among the most visible actors holding governments of immigrant destinations accountable. Focusing on Mexico and the United States, Scaling Migrant Worker Rights analyzes how these organizations pressure governments to defend migrants. The result is a multilayered picture of the impediments to migrant worker rights and the possibilities for their realization. "Highly original and timely, this book shines a light on underexplored actors in the labor rights and protection enforcement process." -- LEAH F. VOSKO, author of Disrupting Deportability: Transnational Workers Organize "A very robust and nuanced empirical analysis documenting how co-enforcement mechanisms across transnational civil society, consulates, and national governments work to implement existing labor rights protections." -- ALEXANDRA DÉLANO ALONSO, author of Mexico and Its Diaspora in the United States: Policies of Emigration since 1848 "This important and innovative work provides a nuanced, rich, and detailed meso-analysis of institutions and institutional collaboration in Mexico and the US." -- NANCY PLANKEY-VIDELA, author of We Are in This Dance Together: Gender, Power, and Globalization at a Mexican Garment Firm.
