Available in PDF, EPUB and Kindle. Book excerpt: The history of the family has become an area of great interest, yet the property arrangements entered into upon marriage, a crucial aspect of the process of familial wealth transmission and distribution in the landed classes in early modern England, have never been systematically studied. In the light of evidence provided by hitherto unused family muniments, Dr Bonfield analyses the legal, social and economic aspects of these settlements, and discusses the development and impact of the strict settlement.

Book Sovereignty Seventeenth Century England and the Making of the Modern Political Imaginary

Download or read book Sovereignty Seventeenth Century England and the Making of the Modern Political Imaginary written by Feisal G. Mohamed and published by Oxford University Press. This book was released on 2020-02-06 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues that sovereignty is the first-order question of political order, and that seventeenth-century England provides an important case study in the roots of its modern iterations. It offers fresh readings of Thomas Hobbes, John Milton, and Andrew Marvell, as well as lesser-known figures and literary texts. In addition to political philosophy and literary studies, it also takes account of the period's legal history, exploring the exercise of the crown's feudal rights in the Court of Wards and Liveries, debates over habeas rights, and contests of various courts over jurisdiction. Theorizing sovereignty in a way that points forward to later modernity, the book also offers a sustained critique of the writings of Carl Schmitt, the twentieth century's most influential, if also most controversial, thinker on this topic.

Book The Law of Contract 1670 1870

    Book Details:
  • Author : Warren Swain
  • Publisher : Cambridge University Press
  • Release : 2015-02-12
  • ISBN : 1316240002
  • Pages : 363 pages

Download or read book The Law of Contract 1670 1870 written by Warren Swain and published by Cambridge University Press. This book was released on 2015-02-12 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: The foundations for modern contract law were laid between 1670 and 1870. Rather than advancing a purely chronological account, this examination of the development of contract law doctrine in England during that time explores key themes in order to better understand the drivers of legal change. These themes include the relationship between lawyers and merchants, the role of equity, the place of statute, and the part played by legal literature. Developments are considered in the context of the legal system of the time and through those who were involved in litigation as lawyers, judges, jurors or litigants. It concludes that the way in which contract law developed was complex. Legal change was often uneven and slow, and some of the apparent changes had deep roots in the past. Clashes between conservative and more reformist tendencies were not uncommon.

Book Land and Credit

Download or read book Land and Credit written by Chris Briggs and published by Springer. This book was released on 2018-02-27 with total page 350 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume investigates the use of mortgages in the European countryside between the thirteenth and eighteenth centuries. A mortgage allowed a loan to be secured with land or other property, and the practice has been linked to the transformation of the agrarian economy that paved the way for modern economic growth. Historians have viewed the mortgage both positively and negatively: on the one hand, it provided borrowers with opportunities for investment in agriculture; but equally, it exposed them to the risk of losing their mortgaged property. The case studies presented in this volume reveal the variety of forms that the mortgage took, and show how an intricate balance was struck between the interests of the borrower looking for funds, and those of the lender looking for security. It is argued that the character of mortgage law, and the nature of rights in land in operation in any given the place and period, determined the degree to which mortgages were employed. Over time, developments in these factors allowed increasing numbers of peasants to use mortgages more freely, and with a decreasing risk of expropriation. This volume will be appealing to academics and researchers interested in financial history, rural credit and debt, and the economic history of agrarian communities.
