Nuestro Código Penal protege los intereses económicos de los diferentes niveles de Hacienda Pública (Unión Europea, Estado, Comunidades autónomas y Corporaciones Locales). En principio, se incurre en delito por defraudar a la Hacienda Pública, tanto por conductas activas como omisivas. El límite objetivo para que sea considerado delito es que la defraudación supere los 120 000 euros tal y como indica el artículo 305 del Código Penal, mientras que el límite subjetivo consiste en que exista un ánimo de engañar, es decir, que exista dolo. Asimismo, existen eximentes y atenuantes que serán objeto, al igual que muchos otros temas, de un exhaustivo análisis científico.Esta obra nace con un carácter investigador y tiene por objeto analizar el delito de defraudación contra la Hacienda Pública del artículo 305 del Código Penal, haciendo especial hincapié en las últimas reformas operadas en el Código Penal y en la Ley General Tributaria. Asimismo, se realiza un análisis exhaustivo de la doctrina científica y jurisprudencia existente hasta la fecha de publicación. Del mismo modo, analizaremos qué infracciones tributarias pueden originar delito fiscal y propondremos mejoras en aras de una menor defraudación tributaria. Un manual, cuyo origen es una tesis doctoral, para quienes quieran especializarse en la materia, sean especialistas o doctorandos, debido a que deja abiertas otras posibles vías de investigación.
