Available in PDF, EPUB and Kindle. Book excerpt: This book asks "How can legal doctrine be turned into filmic art?" By "legal doctrine" Stanley Fish does not mean the sonorous abstractions that usually accompany the self-presentation of law—Justice, Equity, Equality, Liberty, Autonomy, and the like. Rather he has in mind the specific rules and procedures invoked and analyzed by courts on the way to declaring a decision—lawyer/client confidentiality, the distinction between interdicted violence and the violence performed by the legal system, the interplay of positive law and laws rooted in morality, the difference between civilian law and military law, the death penalty, the admissibility of different forms of evidence. In the movies he discusses, these and other points of doctrine and procedure do not serve as a background, occasionally visited, to the substantive issues that drive the plot and provide the characters with choices; they declare the plot, and character is formed and tested in relationship to their demands. Apparently technical matters are pressed until they occupy both foreground and background and become the movie's true subject. If large, abstract concepts emerge, they emerge at the back end of doctrine and are, in effect, produced by doctrine. These are not law-themed movies; they are movies about the unfolding of legal process.

Available in PDF, EPUB and Kindle. Book excerpt: Edward Sakamoto is one of Hawai'i's most popular playwrights. His skillfully constructed depictions of "local life" and command of stylized narrative devices have earned him recognition and acclaim both in the Islands and elsewhere in the U.S. The three plays collected here present an expertly dramatized panorama of life in Hawai'i from 1959 to 1994. A'ala Park explores a working-class milieu with honesty and humor in this gripping study of a young man stunted by a slum environment at the time of statehood. Stew Rice, juxtaposing the hopes of the late 1950s with the realities of the late 1970s, charts the fortunes of three highschool buddies and the consequences of their individual decisions to leave or remain in Hawai'i. Aloha Las Vegas centers on a retired baker, land rich but cash poor, who wrestles with the decision to relocate to Las Vegas in 1994. Sakamoto is quick to challenge easy affirmations and identifications. Beneath their feel-good humor and celebration of local language and culture, the plays have a depth and an unpredictability. As Dennis Carroll observes in his Introduction, all of them center on the theme of "Hawai'i versus the mainland" and the challenges of relocation--the ambiguities of the definition of "home" and whether it can ever be recovered or regained--and the special qualities of local life that can or cannot be transplanted. This theme is relevant to all Americans familiar with the immigrant experience, not only those living in Hawai'i. A glossary of pidgin words and terms is included. Edward Sakamoto's trilogy Hawai'i No Ka Oi is available from Lightning Press. Booksellers: To order, please contact: Ingram Book Co., P.O. Box 3006, La Vergne, TN 37086. Book Trial Films on Trial

Download or read book Trial Films on Trial written by Austin Sarat and published by University Alabama Press. This book was released on 2019-04-02 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: A collection of wide-ranging critical essays that examine how the judicial system is represented on screen Historically, the emergence of the trial film genre coincided with the development of motion pictures. In fact, one of the very first feature-length films, Falsely Accused!, released in 1908, was a courtroom drama. Since then, this niche genre has produced such critically acclaimed films as Twelve Angry Men, To Kill a Mockingbird, and Anatomy of a Murder. The popularity and success of these films can be attributed to the fundamental similarities of filmic narratives and trial proceedings. Both seek to construct a “reality” through storytelling and representation and in so doing persuade the audience or jury to believe what they see. Trial Films on Trial: Law, Justice, and Popular Culture is the first book to focus exclusively on the special significance of trial films for both film and legal studies. The contributors to this volume offer a contemporary approach to the trial film genre. Despite the fact that the medium of film is one of the most pervasive means by which many citizens receive come to know the justice system, these trial films are rarely analyzed and critiqued. The chapters cover a variety of topics, such as how and why film audiences adopt the role of the jury, the narrative and visual conventions employed by directors, and the ways mid-to-late-twentieth-century trial films offered insights into the events of that period.
