Même si de bonnes politiques et pratiques en matière de propriété intel- lectuelle ne peuvent pas à elles seules catalyser l'innovation, car d'autres facteurs sont tout aussi sinon plus importants, de mauvaises politiques et pratiques peuvent l'entraver. Les débats sur les politiques publiques devraient être axés non pas sur la force ou la faiblesse relative de la protection législative, mais plutôt sur des modèles plus efficaces et efficients de gestion de la propriété intellectuelle dans la pratique. Les dé- cideurs disposent de diverses options, dont les suivantes: 1) encourager l'acquisition et la commercialisation des droits de propriété intellectuelle en plus grand nombre possible; 2) encourager le domaine public par la divulgation gratuite du savoir et de la technologie; et 3) utiliser le potentiel des droits de propriété intellectuelle par des modèles d'octroi de licences ouvertes ou fondés sur la collaboration. Il est possible de gérer différentes ressources de différents secteurs d'activité, dans lesquels interviennent différents collaborateurs et différents droits de propriété intellectuelle en alliant diverses approches. Les options stratégiques ne s'excluent pas les unes les autres et le rôle clé des décideurs ne consiste pas à choisir parmi les diverses options, mais à définir les grands principes de base afin de promouvoir le rendement financier, ou autre, du capital investi tout en tenant compte des divers besoins des intervenants.
