This smallest of EU states barely dipped into recession during the global financial crisis and remains a stable member of the Eurozone whilst also having one of the lowest infringement rates and highest transposition of EU law records amongst the 28 member states. Providing the first comprehensive study of Malta's complex road to EU membership this book looks at the impact of membership on the country's political structures and processes and explains the principal factors that have conditioned the country's Europeanization experience. Reflecting Malta's unique and often contentious road to membership, the book explores the historical context and outlines how Maltese processes and policies have changed since membership and whether a causative link exists between these changes and Malta's membership of the EU. A wide range of primary and secondary sources facilitate the study complemented by a series of interviews with a broad range of Malta's political and social actors as well as individuals from EU institutions. This depth of analysis enables a holistic view of Malta's first decade of EU membership and helps establish the fundamental characteristics of Malta's unique Europeanization experience.

As far as the legal obligations are concerned, size does not matter. Smaller Member States have the same obligations as the largest, yet they have to meet these same obligations with very fewer resources. This book examines how the Maltese legal system manages to fulfil its obligations both in terms of the supremacy of EU law, as well as how the substantive EU law is transposed and implemented. It also explores how Maltese courts look at EU law and how they manage, or not manage, to enforce it within the context of national law. It can serve as a model to demonstrate how EU law is being implemented in the smallest Member State and can serve as a basis to study the effectiveness of EU law into the domestic law of its Member States in general.

In other words, do they exercise influence in these processes? And if so, how and at which stage do they do this? This book seeks to answer the above questions by focusing on Malta - the smallest state in the EU - and whether it exercises influence in ‘uploading’ its preferences in two distinct stages of EU legislative decision-making processes - decision-shaping (formation) and decision-taking (adoption). The cases selected and analyzed showcase the Maltese government’s behaviour in legislative negotiations in differing EU policy spheres that are extremely relevant to it. These are the adoption of EU directives on pyrotechnic articles (falling under the EU competition and consumer health and safety policy spheres) and on the extension of EU long-term residence to beneficiaries of international protection (falling under EU immigration policy). As analyzed in the latter chapters of the book, Malta’s government has achieved varying degrees of success in its exercise of influence in these EU decision-making processes.
