This smallest of EU states barely dipped into recession during the global financial crisis and remains a stable member of the Eurozone whilst also having one of the lowest infringement rates and highest transposition of EU law records amongst the 28 member states. Providing the first comprehensive study of Malta's complex road to EU membership this book looks at the impact of membership on the country's political structures and processes and explains the principal factors that have conditioned the country's Europeanization experience. Reflecting Malta's unique and often contentious road to membership, the book explores the historical context and outlines how Maltese processes and policies have changed since membership and whether a causative link exists between these changes and Malta's membership of the EU. A wide range of primary and secondary sources facilitate the study complemented by a series of interviews with a broad range of Malta's political and social actors as well as individuals from EU institutions. This depth of analysis enables a holistic view of Malta's first decade of EU membership and helps establish the fundamental characteristics of Malta's unique Europeanization experience.

As far as the legal obligations are concerned, size does not matter. Smaller Member States have the same obligations as the largest, yet they have to meet these same obligations with very fewer resources. This book examines how the Maltese legal system manages to fulfil its obligations both in terms of the supremacy of EU law, as well as how the substantive EU law is transposed and implemented. It also explores how Maltese courts look at EU law and how they manage, or not manage, to enforce it within the context of national law. It can serve as a model to demonstrate how EU law is being implemented in the smallest Member State and can serve as a basis to study the effectiveness of EU law into the domestic law of its Member States in general.

In May 2004 the European Union will undergo the largest expansion in its history when ten countries -- Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia, and Slovenia -- become members. The number of new members and their diversity make this "big bang" enlargement particularly challenging. Not only do these countries vary widely in language, culture, and geography, but also their per capita income is less than half that of existing members. EU officials believe that expanded integration will serve the EU's objectives of peace, stability, prosperity, and democracy; but the less abstract questions of costs and benefits of enlargement are more complex. Each of the chapters in this CESifo volume addresses a different aspect of EU expansion. The contributors, all leading international practitioners and scholars, consider such topics as the effect of euro zone expansion on European Central Bank monetary policy making; using the euro as an external anchor for a national currency; worker migration and income differentials; the Swiss experience with immigration policy in a direct democracy framework; detailed sector analysis using a computable general equilibrium model of the world economy; investment and job creation and destruction in incumbent member countries; and the asymmetric effects of enlargement on high- and low-income incumbent countries. Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. It showcases the bearing that discourse analytic research can have on our understanding of this phenomenon that is a growing global cause for concern. Although ‘hate speech’ is often incorporated in legal and policy documents, there is no universally accepted definition, which in itself warrants research into how hatred is both expressed and perceived. The research project synthesises discourse analytic and corpus linguistics techniques, and presents its key findings here. The focus is especially on online comments posted in reaction to news items that could trigger discrimination, as well as on the folk perception of online hate speech as revealed through semi-structured interviews with young individuals across the various partner countries.

Book excerpt: The surprising story of how Algeria joined and then left the postwar European Economic Community and what its past inclusion means for extracontinental membership in today’s European Union. On their face, the mid-1950s negotiations over European integration were aimed at securing unity in order to prevent violent conflict and boost economies emerging from the disaster of World War II. But French diplomats had other motives, too. From Africa to Southeast Asia, France’s empire was unraveling. France insisted that Algeria—the crown jewel of the empire and home to a nationalist movement then pleading its case to the United Nations—be included in the Treaty of Rome, which established the European Economic Community. The French hoped that Algeria’s involvement in the EEC would quell colonial unrest and confirm international agreement that Algeria was indeed French. French authorities harnessed Algeria’s legal status as an official département within the empire to claim that European trade regulations and labor rights should traverse the Mediterranean. Belgium, Italy, Luxembourg, the Netherlands, and West Germany conceded in order to move forward with the treaty, and Algeria entered a rights regime that allowed free movement of labor and guaranteed security for the families of migrant workers. Even after independence in 1962, Algeria remained part of the community, although its ongoing inclusion was a matter of debate. Still, Algeria’s membership continued until 1976, when a formal treaty removed it from the European community. The Seventh Member State combats understandings of Europe’s “natural” borders by emphasizing the extracontinental contours of the early union. The unification vision was never spatially limited, suggesting that contemporary arguments for geographic boundaries excluding Turkey and areas of Eastern Europe from the European Union must be seen as ahistorical.
