Mises en perspective avec quelques données occidentales. Sous la rubrique « Contrepoints », Claudine Attias-Donfut, Marie-Odile Bertella Geffroy, Xavier Carpentier-Tanguy, Jean-Marc Ferry, Joseph Maïla, Serge Marti débattent des analyses proposées.Préalablement à ces réflexions, Maurice Godelier propose une définition en quatre points de ce qu’il entend par « représentations culturelles » ; ce qui le conduit à faire la part de l’imaginaire et du symbolique. Il insiste également sur un autre préalable théorique : ne pas coller sur toutes les formes d’individualité sociale et historique les attributs de la personne humaine tels que l’Occident les pense. Apparaissent alors en filigrane dans cet ouvrage les premiers traits d’esquisse d’un Manifeste de l’anthropologie. Prendre en compte et analyser chacun des facteurs qui entrent dans un processus en développement est une exigence scientifique qui impose la mobilisation et la coopération d’un grand nombre de disciplines des sciences sociales et des sciences médicales. Toutes doivent se décentrer et se distancier par rapport aux stéréotypes et préjugés que nos sociétés nourrissent contre les autres sociétés, leurs cultures et leurs pratiques. L’anthropologie pratiquée par un Occidental avec cette rigueur, cette érudition et cette vigilance critique n’est pas une description au service de la domination occidentale sur le reste du monde. Cette anthropologie-là produit un savoir partagé qui bénéficie aussi bien aux partenaires indiens ou africains qu’à leurs collègues européens. Ni arrogance, ni auto-flagellation.

Book excerpt: The need to take the spiritual experience during illness into account is part of a broader trend in Western societies—a fascination with the practical uses of spirituality and its contribution to individual wellbeing, whether through a religious or a humanist tradition. This understanding of spirituality differs from traditional views embedded in religious traditions. This book takes a critical point of view at the biomedical representation of the function of spirituality in care. Medicine reorders notions such as life, death, health, sickness, and spirituality. This process is called here “sapientialization”, i.e. the spiritual experience is expressed and understood under the auspices of and in terms of wisdom. This view tends to identify spirituality and ethics. I propose an alternate understanding of spirituality, grounded on its subversive power. Inspired by the work of the theologian John D. Caputo, it is critical of some problems that are associated with the sapientialization of spirituality in biomedicine, such as the medicalization of spiritual experiences or the instrumentalization of spirituality. It provides an understanding of spirituality that honours both the medical interest in it and its capacity to resist to instrumentalization.

In the Western liberal tradition, from a strictly legal and theoretical perspective the social individual has the right to exercise the autonomy of his or her will. In a context of legal plurality, however, personal autonomy becomes more complicated. Can and should personal autonomy be recognized as a legal foundation for protecting a person’s freedom to renounce what others view as his or her fundamental ‘human rights’? This collection develops an interdisciplinary conceptual framework to address these questions and presents empirical studies examining the gap between the principle of personal autonomy and its implementation. In a context of cultural diversity, this gap manifests itself in two particular ways. First, not every culture gives the same pre-eminence to personal autonomy when examining the legal effects of an individual’s acts. Second, in a society characterized by ‘weak pluralism’, the legal assessment of personal autonomy often favours the views of the dominant majority. In highlighting these diverse perspectives and problematizing the so-called ‘guardian function’ of human rights, i.e., purporting to protect weaker parties by limiting their personal autonomy in the name of gender equality, fair trial, etc., this book offers a nuanced approach to the principle of autonomy and addresses the questions of whether it can effectively be deployed in situations of internormativity and what conditions must be met in order to ensure that it is not rendered devoid of all meaning.
