Download or read book The Sources of Labour Law written by Tamás Gyulavári and published by Kluwer Law International B.V.. This book was released on 2019-12-06 with total page 634 pages. Available in PDF, EPUB and Kindle. Book excerpt: Labour law has traditionally aimed to protect the employee under a hierarchy built on constitutional provisions, statutory law, collective agreements at various levels, and the employment contract, in that order. However, in employment regulation in recent years, ‘flexibility’ has come to dominate the world of work – a set of policies that reshuffle the relationship among the fundamental pillars of labour law and inevitably lead to degrading the protection of employees. This book, the first-ever to consider the sources of labour law from a comparative perspective, details the ways in which the traditional hierarchy of sources has been altered, presenting an international view on major cross-cutting issues followed by fifteen country reports. The authors’ analysis of the changing hierarchy of labour law sources in the light of recent trends includes such elements as the following: the constitutional dimension of labour rights; the normative intervention by the State; the regulatory function of collective bargaining and agreements; the hierarchical organization of labour law sources and the ‘principle of favour’; the role played by case law in both common law and civil law countries; the impact of the European Economic Governance; decentralization of collective bargaining; employment conditions as key components of global competitive strategies; statutory schemes that allow employees to sign away their rights. National reports – Australia, Brazil, China, Denmark, France, Germany, Hungary, Italy, Poland, Russia, Spain, Sweden, South Africa, the United Kingdom and the United States – describe the structure of labour law regulations in each legal system with emphasis on the current state of affairs. The authors, all distinguished labour law scholars in their countries, thus collectively provide a thorough and comprehensive commentary on labour law regulation and recent tendencies in national labour laws in various corners of the globe. With its definitive analysis of such crucial matters as the decentralization of collective bargaining and how individual employment contracts can deviate from collective agreements and statutory law, and its comparison of representative national labour law systems, this highly informative book will prove of inestimable value to all professionals concerned with employment relations, labour disputes, or labour market policy, especially in the context of multinational workforces.

The Australian Charter of Employment Rights is a blueprint for the future of industrial relations in Australia.
The Charter is a back-to-basics attempt to define the rights of workers and employers. It is a simply expressed contemporary document that draws upon international as well as uniquely Australian rights and values to create a set of rights and obligations which all workplaces are encouraged to adopt and observe. The Charter enables a critique of current labour laws and any proposals for change.
The Australian Charter of Employment Rights is the collaborative effort of seventeen of Australia’s leading IR practitioners, lawyers and economists, edited by Mordy Bromberg and Mark Irving. It is the initiative of the Australian Institute of Employment Rights, an independent tripartite body representing workers, employers and the public interest.
“The Charter of Australian Employment Rights leads the way for industrial relations in Australia – a way towards greater harmony and greater prosperity. It is a worthy objective, which can be achieved by employers and workers adopting a template for workplace fairness.”
Bob Hawke

Download or read book Labour Law in Australia written by Brian Thomas Brooks and published by Springer. This book was released on 2003 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: It has been said that the Australian system of industrial relations is as exotic as the boomerang and the kangaroo. Indeed, Australia's impressive array of industrial relations systems and dispute settlement procedures, at both the state and federal levels, makes Labour Law in Australia a particularly challenging area of practice. By the same token, from an academic perspective Australia offers a virtually unique opportunity to study the social and legal forces that have shaped the evolution of industrial relations systems throughout the twentieth century, and that continue to shape them as we enter the twenty-first. Labour Law in Australia gives the practitioner a concise but thorough guide to the field as it stands today, with its notable extremes of compulsory arbitration tribunals on the one hand and almost total deregulation on the other. Among the numerous specific topics covered are the following: awards, Australian workplace agreements, and certified agreement the role of the Australian Industrial Relations Commission and other institutions, both state and federal matters that may be determined by tribunals application of a national wages policy the award simplification programme collective agreements rights and duties of employees and employer legal controls of trade unions legal forms of industrial action the role of employers' organizations workers' participation in enterprises criteria for tribunal decisions. The implications for practitioners of distinctive current labour market features, such as the prevalence of part-time and casual work, and the large government outlays for training programmes, are fully spelled out, as are the procedural measures arising from the formidable resilience of the trade union movement. With its practical guidance and penetrating insights, Labour Law in Australia is the ideal resource for business people, government regulators, and academics concerned with legal matters affecting the Australian labour market.

Download or read book Regulation Theory and Australian Capitalism written by Brett Heino and published by Rowman & Littlefield. This book was released on 2017-11-22 with total page 294 pages. Available in PDF, EPUB and Kindle. Book excerpt: The end of the post-World War II ‘long boom’ in the mid-1970s proved the beginning of a process of political-economic change that has fundamentally transformed labour law, both in Australia and across the developed world more generally. This is a phenomenon with deep ramifications for social justice. The dissolution of productive industry, the fragmentation of employment categories, the rise of profound employment precarity and an increasingly hostile legal environment for trade unionism have been of immense significance for key social justice issues, including income inequality, the rise of a new working-underclass, and the marginalization of organised labour. By combining the concepts of the Parisian Regulation Approach with an explicitly Marxist jurisprudence, this study offers a theoretically rigorous yet empirically sensitive account of legal transition, with key case studies in the metal, food processing and retail sectors. Given the similar development logic of post-World War II capitalism in Western societies, this theory, although operationalised in the Australian context, can be used in the effort to explain labour law change more broadly.

This book was released on 2003-01-01 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thirty-three distinguished authorities in the field of labour and industrial relations law gather here to enhance and complement the work of the late Marco Biagi, a man who, at the time of his violent and untimely death, had shown himself to be the most insightful and committed international scholar in this complex and controversial and, as it proved, even dangerous field. There is a lot of insight, innovation, and just clear thinking in this wide-ranging and far-reaching book. It will be of exceptional value to scholars, lawyers, and others concerned with the extensive and unpredictable changes under way in today's world of work.
