La responsabilidad principal de Abastecimiento es asegurar que estos actores vitales en el proceso, cumplan con sus obligaciones de manera segura y oportuna a través de los procesos, procedimientos, indicadores y recursos adecuados de gestión de contratos y órdenes de compra en términos de HSE, calidad, costo y plazo.En muchos procesos de gestión de contratos, se pasan por alto oportunidades de mejora en áreas como: Descripciones de los servicios y especificaciones técnicas; gestión de riesgos; estructuras de costos; indicadores de desempeño; entre otras impidiendo que el contratista o proveedor cumpla a tiempo, de manera segura y dentro del presupuesto. Se afectan así los planes anuales de compras y contrataciones de la Empresa, poniendo en peligro las metas y objetivos corporativos.El sector energía, en sus segmentos de exploración y explotación de petróleo, transmisión de energía, transporte de gas al igual que el sector minero, están expuestos a altos niveles de riesgo durante el cumplimiento de las obligaciones contractuales por parte de contratistas y proveedores.Una amplia gama de contratistas y subcontratistas se requieren en estos sectores para construir infraestructura, ofrecer soluciones de ingeniería y consultoría, suministrar y operar equipos altamente especializados, solventar necesidades misceláneas de transporte, servicio comunitario, logística, protección, trámites gubernamentales, personal especializado, por mencionar unas pocas.Por esta razón la gestión contractual es crítica y es imprescindible lograr que los gerentes de contratos acompañen y supervisen el desempeño de contratistas y proveedores para identificar tempranamente posibles desviaciones, incumplimientos, retrasos, reclamos, etc. que sea necesario encarar oportunamente con las medidas de mitigación requeridas. Si bien el centro de gravedad en cuanto a roles y responsabilidades «una vez suscrito el contrato», migra de Abastecimiento al gerente del contrato, el primero sin embargo debe estar al tanto de la gestión de actividades de contratación y compras posteriores a la adjudicación, para brindar su respaldo en caso de necesidad. Procesos y actividades propios de la gestión de contratos, como supervisar y medir el desempeño de contratistas y proveedores, administrar el manejo del cambio, gestionar el proceso de facturación y pago, controlar pólizas y garantías, tramitar reclamos y negociación, deben integrarse con otros procesos centrales departamentales tales como contabilidad, gestión financiera, gestión de riesgos y seguros, TI y el área jurídica.Una gestión ineficiente de los contratistas y proveedores puede causar un deficiente control operativo, insatisfacción del cliente interno, altos riesgos y mayores costos no deseados. Un proceso de selección de un proveedor o contratista puede malograrse por una inadecuada gestión del contrato.Los anteriores son temas dispersos involucrados en la gestión de contratos que seguramente han sido temas del interés del lector y en algunas ocasiones por desconocimiento, pueden haber generado situaciones de marca mayor que hubieran podido evitarse de contar con las destrezas y competencias requeridas. Infortunadamente al menos en Colombia la educación a nivel de pregrado, desconoce el impacto y el valor que una adecuada gestión de contratos puede agregar a las empresas.El libro con una visión eminentemente práctica, recorre el macro proceso de gestión de contratos describiendo procesos, prácticas, políticas, herramientas y desarrollos, resultantes de una amalgama de conocimientos y experiencias adquiridos y puestos a prueba en el sector energía.

Por otro lado, las facultades de Ingenier�a y Arquitectura poca o relativa importancia han dado a este tema, porque err�neamente se piensa que es una responsabilidad exclusiva de abogados, sin advertir que todos los profesionales deben conocer los fundamentos que les permitan contratar de manera s�lida y confiable en un medio altamente competitivo.Cada empresa seg�n sus necesidades debe ajustar, ampliar o regular sus propios procesos y procedimientos, buscando su propia legislaci�n interna con la suficiente flexibilidad para contratar, sin exceso de controles administrativos, muchos de los cuales son un lastre remanente de la contrataci�n administrativa.En medio de una crisis como la que enfrenta el planeta, en la cual la deshonestidad y la corrupci�n no son extra�as a las pr�cticas de contrataci�n especialmente con el Estado, la empresa madura y seria debe caracterizarse por una activa receptividad que busque en un per�odo muy corto el fortalecimiento y aplicaci�n de procesos completos y satisfactorios de Abastecimiento.En �ltima instancia, la intenci�n del libro es rescatar conocimientos que se encuentran dispersos y buenas pr�cticas que han contribuido a establecer un conjunto coherente de acciones que han rendido buenas o incluso excelentes soluciones en un determinado contexto y que se espera que, en entornos similares, rindan similares resultados, d�ndoles una estructura y organizaci�n l�gica, adaptadas a la secuencia del proceso de seleccionar proveedores y contratistas.El macro proceso a analizar, considera las actividades previas a la contrataci�n que desembocan en la selecci�n de un contratista o proveedor y en el perfeccionamiento de un documento contractual ll�mese contrato, orden de trabajo, orden de servicio, etc.; La responsabilidad en esta fase est� en cabeza de quien sea responsable por el proceso de Abastecimiento "compras y contrataci�n".Al final de cada fase o cap�tulo se han incluido diagramas de flujo de responsabilidades, formatos, tablas y ejemplos que pueden constituirse en gu�as en el proceso.
