Hall's excellent earlier biography (1973) by providing an alternative interpretation of the man and his mission, namely that he is 'overwhelmingly closer to the social evolutionist's view of social change', with a considerable debt to the writings of Spencer rather than the Utalitarian philosophy of J. S. Mill. In other words, Mori was able to develop a workable philosophy of government and administration in line with the pragmatic needs of Japanese society. The book, therefore, will contribute to a radical rethink of Japanese perceptions of the Meiji reforms seen in their own terms.

Book excerpt: Local authority control of audit and performance provides opportunities to improve value for money and to focus more closely on local priorities. However, there are significant risks to accountability for public money unless new legal and practical arrangements are put in place to uphold the vital principle of auditor independence. Until now the Audit Commission has been the regulator, commissioner and major provider of local government audit services (undertaking 70% of the local government audit and commissioning the remaining 30% under contract from five private audit firms). Under the changes proposed, local government will in future appoint their own auditors. The Government plans to introduce a public audit bill in the autumn. The Committee argues this legislation must set out a number of key principles to govern public audit arrangements in the future: strict adherence to the principle of auditor independence; a majority of independent members on any local audit committee; additional safeguards to ensure the continued effectiveness of public interest reporting; a proportionate and risk based approach to the scope of local government audit - to permit local innovation and application, particularly with regards to local value for money work. The Committee also welcomes the LGA's proposals for sector-led performance management, but calls on the Government to clarify arrangements for intervention in the exceptional cases of serious corporate or service failure. It also repeats its call for the Government to examine the contribution which robust local government scrutiny arrangements could make to improving local government performance.

Constitutional change may be formal, involving amendments to the texts of Constitutions or the passage of legislation of a clearly constitutional kind, or informal and organic, as where court decisions affect the operation of the system of government, or where new administrative and other arrangements (eg agencification) affect or articulate or alter the operation of the constitution of the country, without the need to resort to formal change. The countries in this study include, from the EU, a common law country, a Nordic one, a former communist state, several civil law systems, parliamentary systems and a hybrid one (France). Chapters on non EU countries include two on developing countries (India and South Africa), two on common law countries without entrenched written constitutions (Israel and New Zealand), a presidential system (the USA) and three federal ones (Switzerland, the USA and Canada). In the last two chapters the editors conduct a detailed comparative analysis of the jurisdiction-based chapters and explore the question whether any overarching theory or theories about constitutional change in liberal democracies emerge from the study.

Book excerpt: This book is the result of a research project carried out for the Committee of the Regions and analyses the 'state of play' of democratic practice at the subnational level in all of the European Member states. Its initial hypothesis was that liberal democracy is closely associated with the rise of the nation state in the 19th century. The nation state, however, has been significantly changing under the impact of various forces including globalization and regionalization, internal reforms of the public administration system such as privatization and deregulation, and the emergence of regions and local authorities as actors in their own rights. these changes pose challenges for the practice of democracy and, in particular, for its expression at the regional and local level. The book deals with the theoretical implications of these changes in terms of the changing nature of the state and new regionalism. However, one of the key findings is that there is no one uniform meaning of democracy across member states and there are variations even within a single state depending on whether the national or subnational levels are considered. Each country chapter gives the historical and philosophical background to the concept of democracy in each country. There is also an exposition of the institutional expression of democracy at the different levels. With regard to the practice of democracy at the subnational level, the role of pressure groups and policy networks is examined as well as the role of political parties. There is a survey of critiques of subnational democracy. Finally, there is a survey of innovative approaches to improving regional and local democracy through a variety of mechanisms and reforms as ways of responding to the challenge and opportunities facing it today
