Book excerpt: Le droit social est aujourd'hui inévitablement confronté à la notion de concurrence et à l'application du droit de la concurrence. La cohabitation entre concurrence et droit social, illustrée par une tolérance de principe du droit de la concurrence à l'égard du droit social et par la perméabilité grandissante de ce dernier par rapport à la concurrence, ne doit toutefois pas cacher certains risques de conflits, qui sont aujourd'hui bien présents. Ces risques de conflit entre concurrence et droit social, sont illustrés par la concurrence déloyale et par les effets négatifs des restructurations d'entreprises dans la sphère du social. Dans un contexte où on assiste à une montée en puissance de la concurrence, il devient ainsi nécessaire de mettre en oeuvre des moyens et de rechercher des solutions pour faire en sorte que celle-ci affecte le moins possible de manière négative le droit social. L'impact négatif de la concurrence sur le droit social ne peut pas être combattu par un seul moyen. Une action convergente des autorités communautaires et nationales, ainsi que l'implication des acteurs non gouvernementaux s'avèrent nécessaires.
