Book excerpt: Le risk-sharing doit permettre d’amortir des chocs asymétriques au sein d’une zone monétaire. Trois canaux d’ajustement peuvent jouer : les transferts publics, les crédits, et les revenus financiers entre les régions/pays. La littérature souligne la faiblesse actuelle de ce mécanisme en Europe, tandis qu’elle tend généralement à lui prêter un rôle majeur aux Etats-Unis. Dans ce travail, nous montrons que pour les Etats-Unis le canal financier est généralement surestimé. Ces résultats conduisent à réévaluer le rôle du budget fédéral. Nous complétons notre analyse à l’aide d’un modèle « stock flux cohérent » (SFC) à deux pays en Union monétaire, s’inspirant des travaux de Godley et Lavoie (2007). Les effets de stabilisation liés à l’intégration financière apparaissent plus faibles que les effets de diffusion. Nous étudions également les effets d’un rationnement bancaire sur les entreprises et les gouvernements. Si le financement extérieur s’accompagne de plans d’austérité budgétaires, l’ajustement d’un choc asymétrique est inefficace. Finalement, la stabilisation à travers l’intégration financière s’avère limitée et ne peut combler à elle seule le vide politique de la zone euro qui constitue une union monétaire incomplète sans mécanismes budgétaires entre les pays. Cette situation accentue les déséquilibres entre les pays du nord et du sud et remet en cause la viabilité de la zone euro.

Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Conventional theories of European integration struggle to explain this paradox because they equate integration with the empowerment of specific supranational institutions under the traditional Community method. New governance scholars, meanwhile, have not filled this intellectual void, preferring instead to focus on specific deviations from the Community method rather than theorizing about the evolving nature of the European project. The New Intergovernmentalism challenges established assumptions about how member states behave, what supranational institutions want, and where the dividing line between high and low politics is located, and develops a new theoretical framework known as the new intergovernmentalism. Created by the governors of the Bank of England and the Reichsbank in 1930, and protected by an international treaty, the BIS and its assets are legally beyond the reach of any government or jurisdiction. The bank is untouchable. Swiss authorities have no jurisdiction over the bank or its premises. The BIS has just 140 customers but made tax-free profits of 1.17 billion in 2011-2012. Since its creation, the bank has been at the heart of global events but has often gone unnoticed. Under Thomas McKittrick, the bank's American president from 1940-1946, the BIS was open for business throughout the Second World War. Yet despite its pivotal role in the financial and political history of the last century and during the economic current crisis, the BIS has remained largely unknown -- until now.
