En effet, le champ de l’emploi fait partie des tous premiers domaines d’intervention, ciblé dès 1998 par une série de mesures spécifiques. Point nodal des processus de solidarité et d’intégration sociale, il nous fait vivement ressentir tout écart à l’idéal méritocratique d’égalité et de justice sociale. Selon le baromètre du Défenseur des droits, en 2016, plus d’un tiers de la population active rapporte une expérience vécue de discrimination en emploi, alors que ce chiffre s’élève à plus de 60% pour des catégories particulièrement exposées. Sans prétendre épuiser ces enjeux, l’objectif de ce numéro sera d’interroger, au croisement des sciences sociales et du droit, le déploiement normatif, comme en matière de politique publique, du référentiel de la non-discrimination en emploi. Les contributions réunies proposent toutes à leur manière de jeter un éclairage sur le chemin parcouru en vingt ans, les réalisations accomplies, mais aussi les angles morts et les impasses, autour de trois thèmes forts : l’étude critique de l’évolution du dispositif juridique antidiscriminatoire, confronté au moment où son institutionnalisation arrive à maturité, à l’épreuve de son effectivité ; les freins demeurant à la reconnaissance juridique des discriminations, ainsi que la portée des stratégies judiciaires, et plus particulièrement en emploi ; l’articulation problématique enfin entre ce référentiel normatif, juridique de la non-discrimination et les initiatives portées par les acteurs sociaux, avec le soutien des pouvoirs publics, autour d’une régulation technique, via certifications et labels, de la diversité au travail.

Book excerpt: This thesis is composed of three mostly empirical papers related to discrimination on the French labor market and one methodological paper using American data. The first one focuses on the wages and the employment status of French workers of Maghrebian origin, the second one focuses on their wages and hierarchical positions, the third one focuses on the heterogeneity of their employment gap relative to French workers whose parents were French at birth, and the fourth one re-examines the data from a controlled experiment assessing the impact of a criminal record on the probability of being hired. The value added of these papers is twofold. First they provide new evidence regarding the situation of second generation immigrants on the French labor market. Differences in wages and employment are high. However, once taken into account individual characteristics (age, qualification, etc.), most of the wage gaps disappear, but substantial differences in employment and hierarchical positions remain. Moreover we provide an original description of the heterogeneity of the employment gap showing that it is wider for the individuals whose characteristics are associated to the lower employment probabilities (as identified in the reference population) than for those with the higher ones. Second, these papers bring methodological material to study discrimination. The first three papers try to incorporate notations and ideas which are now standard in public policy evaluation and consequently raise new issues regarding the decompositions of wage and employment gaps. The fourth article tries to discuss the methods commonly used in paired audit studies.

Les résultats montrent que la discrimination à l’embauche à l’encontre des candidats issus de l’immigration est massive. Cette inégalité affecte toutes les candidatures d’origine étrangère, rejetant l’hypothèse d’une défiance ciblée à l’encontre de vagues particulières d’immigration. La question de la discrimination se pose ainsi surtout en termes d’opposition entre le groupe majoritaire, « autochtone », et l’ensemble des individus issus de l’immigration. Il faut cependant noter que la discrimination d’origine affecte beaucoup plus les candidatures masculines que les candidatures féminines. "
