Book excerpt: In his will, Simeon S Hyde manumitted his slave Minnie and her eight children, and made them his sole legatees. The plaintiffs, Hyde's heirs-at-law, claimed the estate from the slaves' guardian on the grounds that the manumissions were void and that Hyde had lived in concubinage with Minnie. The Supreme Court found that the issue of concubinage was immaterial to that of manumission and that a verbal statement from Hyde that he was Minnie's children's father had no bearing on the issue either. It was ruled that under the will the slaves gained only an inchoate right to freedom, subject to be brought to fruition by the proper legal avenues before they ceased to be slaves; subsequent legislation of 1857 prohibited any manumissions, though the slaves retained the inchoate right given to them by the will which stood to be revived if the law was changed once again.

Book excerpt: Plaintiff sued defendant, whom he had hired as an overseer of his plantation, for the price of a mule, hire of slaves and [dollars] 600 which he alledged the defendant had stolen from him. The defendant denied the accusation and claimed the wages due to him. The issue was first tried before a jury on 1 December 1849. They returned a verdict in favour of the plaintiff for [dollars] 503-50 and the defendant appealed. The case was first head by the Supreme Court in October 1851, but went unreported. It had reversed the verdict and remanded the case for a new trial. The District Court, with a new jury, then found for the defendant, awarding him [dollars] 225 in wages and [dollars] 3,500 in damages. The plaintiff appealed to the Supreme Court. It had to consider whether the plaintiff's case was a malicious prosecution. It reversed the decision of the court below and gave a final verdict for the plaintiff. The defendant had to pay [dollars] 100 for the value of the mule, plus costs in both courts. The accusations by the defendant of slander and a malicious prosecution were dismissed. His claim for wages was also dismissed and recorded as a non-suit.

The appellants prayed that there had been no calls for them to present the body of their principal to the court before the judgment of forefeiture of their bond was made against them. The Supreme Court found that the records of proceedings showed that they had been frequently called upon to present their principal. Judgment affirmed.

Whetstone was accused of failing to hire an overseer on his plantation. Such a violation incurred a fine of [dollars] 50 a month for the duration of the offence. Judgment was reversed in favour of the defendant.

Davis moved to quash the indictment on the bases that the jury had not been empanelled on the first day and that there was no statute prohibiting a free person from shooting a slave; this was sustained, and the state appealed. The Supreme Court found that there had been no irregularities regarding the jury and that the law did prohibit the shooting of slaves. The case was therefore ordered to proceed.

Book excerpt: Alford brought this action for the restitution of the price of a slave, Charlotte, who he alleged was afflicted with disease at the time of the sale by the defendants, and that this disease was known to the defendants and concealed from him by them. The court found for the defendants and the plaintiff appealed. The Supreme Court noted that the earliest evidence which related to the visibility of the disease referred to a period a month after the sale. Judgment upheld.

Book excerpt: This was an action to recover property, a female slave and various town lots in Farmerville. The property had been seized in 1849 to meet a debt claimed by Carrollton, Frothingham & Company. The sheriff of the parish of Union had sold the property, but there was an adjudication in favour of the plaintiff. The defendants, Paul Tulane and Company obtained a judgement against the plaintiff's husband, disregarded the adjudication to the plaintiff, and took the property in question. The plaintiff had been given the two slaves, Tom and Henrietta, and a small sum of money in a partition in February 1840. In 1842 her husband moved from Georgia to Louisiana and she followed a year later. In 1846 the husband sold Tom to Feazel for [dollars] 600. The plaintiff, Henderson, had filed successfully for separation of property from her husband in 1849, claiming [dollars] 600 for the price of her slave Tom whom her husband sold, and [dollars] 700 for her share of the proceeds of land sales in Alabama and Georgia. The defendants claimed that the separation was fraudulent. They lost their case in the District Court and appealed. The appeal by the defendants centred on differences in State laws. The defendants argued that under Georgia law the slaves became her husband's property upon marriage. The plaintiff argued that the slave Tom, as well as the money, was not received by Henderson until he had moved to Louisiana. Judgement was affirmed in favour of the plaintiff. Defendants had to pay the costs of the appeal.

The plaintiff had received wages for the time leading up to his discharge, but not for the entire year. Judgement in favour of the defendant was affirmed.
