De un marco multilateral claro y predecible, pasamos a un panorama jurídico complejo, dominado por la proliferación de los tratados de libre comercio, muchos de ellos bilaterales. Dos de los principales impulsores de estos acuerdos son Estados Unidos y la Unión Europea, aunque el enfoque y el alcance de sus políticas comerciales difieren. Esta situación es merecedora de un análisis sólido, serio y riguroso, cuestión que afronta esta obra. Estamos, pues, ante un libro que analiza la problemática relación de estos tratados con el marco multilateral planteado en la Organización Mundial del Comercio, para a continuación centrarse en detalle en el contenido de los acuerdos, que abarcan desde ámbitos clásicos, como la liberalización del comercio de mercancías, a otros más novedosos, como la cooperación normativa o el difícil encaje de los mecanismos de solución de diferencias relativos a inversiones. Todo ello, sin dejar de lado los elementos más problemáticos de la actualidad comercial, como la deriva proteccionista de Estados Unidos, o los hitos jurisprudenciales que aclaran el alcance competencial de la Unión Europea en relación a la Política Comercial Común.

Book excerpt: El comercio internacional ha permitido grandes beneficios para los países que desarrollan los acuerdos en función de sus intereses, a lo largo de los años son más países interesados en realizar acuerdos de libre comercio con el objeto de obtener una relación donde las naciones involucradas quede satisfechas a nivel de ganancias. En el caso de potencias mundiales como Estados Unidos y la Unión Europea las relaciones ejercen mayor relevancia, ya que su economía ocupa el 40% del PIB mundial, por tal razón el objetivo de este trabajo se basa en analizar las relaciones bilaterales entre estos dos regiones, haciendo un énfasis en los acuerdos desarrollados a partir del partida el llamado Acuerdo General sobre Aranceles Aduaneros y Comercio (General Agreement on Tariffs and Trade, GATT, su principios, el surgimiento de la Organización Mundial del Comercio y su nueva estructuración. Adicionalmente se analiza la Asociación Transatlántica para el Comercio y la Inversión (Transatlantic Trade and Investment Partnership, TTIP), tratado que se ha estado negociando entre los EE. UU y la UE, considerando sus objetivos, impactos, expectativas y efectos dentro de los sectores económicos de estas regiones. In the past 15 years, the nations of the Western Hemisphere have staged a remarkable revolution—in the way they trade with their neighbors. First, after decades of restrictive import policies, several countries began to liberalize their trade and investment regimes. Then, beginning a decade ago, numerous bilateral and sub-regional trade agreements were achieved, to serve as vital complements to domestic reforms and to foster trade flows among member countries. At the Second Summit of the Americas in 1998, negotiations among 34 democracies were launched to establish the Free Trade Area of the Americas (FTAA). This report takes stock of the remarkable progress to date in the development of free trade in the Western Hemisphere. It examines trade flows between countries in the same regional groupings and between members of different sub-regional arrangements. The report describes the main characteristics of the trade arrangements signed between countries of the Hemisphere and explores the development of trade rules in these arrangements. Finally, the report details recent advances in the construction of the FTAA.
