Book excerpt: En este libro los autores realizan un estudio de los diferentes elementos que definen la responsabilidad ambiental, y enfatizan en sus particularidades para así diferenciarla de las instituciones generales de la responsabilidad civil extracontractual. De este modo, en comienzo se define el concepto de daño y se subraya el carácter colectivo del medio ambiente y su diferenciación con aquellos daños individuales que pueden generarse de manera conexa. Asimismo, se diferencia la afectación o lesión del bien colectivo de las lesiones conexas o reflejas que puede llegar a generar, puesto que no es lo mismo el daño que se causa a las aguas de un río que la afectación al derecho a la salud de quienes habitan en la ribera del mismo. La caracterización del daño ambiental conduce a un replanteamiento del concepto de derecho subjetivo, ya que en el proceso no debe demostrarse en estricto sentido la afectación de un interés personal, sino que el individuo actúa en realidad como miembro de la colectividad. Continúan los autores con el desarrollo del segundo elemento de la responsabilidad, es decir, la imputación. Al abordar esta temática advierten que tratándose de medio ambiente existe una dificultad de atribución de responsabilidad, comoquiera que en muchas oportunidades no es posible tener certeza de la fuente originaria del daño o si este se debe a la confluencia de varias actividades e incluso a la intervención de fenómenos naturales. Dentro de este contexto se ilustra sobre la utilización de instrumentos jurídicos nuevos como el principio de precaución y la utilización de presunciones de responsabilidad.

El ya bien estructurado régimen de responsabilidad extracontractual, no necesariamente se constituye en una garantía de certidumbre jurídica para atender a las particularidades que tales daños revisten. Cuando estas normas se han ocupado del tema del daño, han sido equívocas en la determinación de aspectos tales como los presupuestos de responsabilidad, el alcance de la reparación y las competencias para hacerla exigible. Todo ello compromete la integridad del ambiente y la responsabilidad de un Estado que, al estar constitucionalmente obligado a protegerla. Esta obra propone advertir sobre las particularidades del daño ambiental puro respecto de otros generadores de responsabilidad extracontractual, la ausencia de un marco normativo que logre atender a esas particulares y demás dificultades que desde el punto de vista jurídico se presentan para lograr una reparación.
