Se dará un enfoque especial al maltrato infantil y se relacionaran conceptos como bien jurídico protegido, elementos normativos del tipo y el principio de insignificancia. Se acudirá a criterios jurisprudenciales y opiniones doctrinales principalmente españolas, debido a que su legislación contempla figuras penales similares y de contexto internacional en relación al maltrato infantil. El presente estudio busca una aproximación exploratoria en la descripción de los delitos de "maltrato corporal relevante" y el "trato degradante" tipificados en la ley 21.013, la cual por su reciente data no tiene mayor discusión nacional a nivel doctrinal, como así mismo, un desarrollo jurisprudencial que permita evidenciar cómo se desarrollan los tipos en lo concreto. La dictación de esta nueva ley, obedece en lo sustancial a la existencia del pleno consenso respecto de la necesidad de dar protección a los niños, las niñas y adolescentes frente a toda forma de maltrato físico o psicológico, independiente de que éste se produzca o no en el contexto intrafamiliar; todo, en el contexto temporal de los múltiples casos de maltrato infantil, develados recientemente a la opinión pública, ejercidos por personas contratadas, paradojalmente, para su cuidado y protección; es decir, por terceros sin ningún tipo de vínculo de parentesco, pero que, sin embargo, ejercen un cuidado legal de estos menores.
