Para identificar y evaluar la presencia del derecho dentro de esa negociación este texto ha sido dividido en seis capítulos. El primero hace una aproximación conceptual al concepto de estándares entendidos como las pautas y reglas articuladas por el sistema Internacional de Protección de los Derechos Humanos. El capítulo dos reconstituye los estándares construidos por la Corte Interamericana relacionados con los derechos de las víctimas desde juzgamientos hechos a Honduras Guatemala Perú y Colombia. El capítulo tres se ocupa del análisis de los diversos proyectos de ley radicados en el congreso durante la discusión de la que luego sería la Ley 975 de 2005. Realizando este análisis se da paso al cuarto capítulo donde el objeto de estudio es la Ley 975 de 2005 sus fortalezas y debilidades. El capítulo cinco aborda el tema del control ejercido por la Corte Constitucional a la ley y las consecuencias del mismo; es la parte más extensa del libro y evidencia el esfuerzo de la Corte por ajustar una ley a los estándares internacionales de protección de modo tal que resultara posible salvar el proceso. Finalmente el capitulo seis describe el manejo de las normas y el derecho dentro de la negociación especialmente por medio de decretos reglamentarios dentro de una ruta en la que se imponen acuerdos individuales.

Part II, 'The Analytics of Transitional Justice', proposes a framework for explaining the variations among the cases - why after some transitions wrongdoers from the previous regime are punished severely and in other cases mildly or not at all, and victims sometimes compensated generously and sometimes poorly or not at all. After surveying a broad range of justifications and excuses for wrongdoings and criteria for selecting and indemnifying victims, the 2004 book concludes with a discussion of three general explanatory factors: economic and political constraints, the retributive emotions, and the play of party politics.
