Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, it aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series begins this enterprise with an appraisal of the evolution of the state and its administration, with cross-cutting contributions and also specific country reports. While the former include, among others, treatises on historical antecedents of the concept of European public law, the development of the administrative state as such, the relationship between constitutional and administrative law, and legal conceptions of statehood, the latter focus on states and legal orders as diverse as, e.g., Spain and Hungary or Great Britain and Greece. With this, the book provides access to the systematic foundations, pivotal historic moments, and legal thought of states bound together not only by a common history but also by deep and entrenched normative ties; for the quality of the ius publicum europaeum can be no better than the common understanding European scholars and practitioners have of the law of other states. This book looks at what that transition has meant for the Spanish people. Drawing on national surveys taken in 1978, 1980, 1984, and 1990, the authors explore three questions: What is the basis of the new regime's political legitimacy? How did Spanish democracy move from the conservative center-right coalition that engineered the transition to the socialist government that consolidated it? And why is political participation so low among Spaniards? The answers to the first two questions highlight the ambiguity built into the political contrast with the Franco regime and a certain appreciation of the material accomplishments of authoritarianism, the pivotal role of the king in opting for democracy while symbolically spanning traditional and modernizing forces, and finally a movement from foundational issues to economic and social concerns. In response to the third question, the authors illuminate the participatory shortfall in Spanish politics by comparing Spain with Brazil and Korea, two post-authoritarian societies where political involvement is much higher. They consider long-term structural factors as well as short-term strategic actions that have contributed to low civic engagement.

Book excerpt: This book discusses civil litigation at the supreme courts of nine jurisdictions – Argentina, Austria, Croatia, England and Wales, France, Germany, Italy, Spain and the United States – and focuses on the available instruments used to keep the caseload of these courts within acceptable limits. Such instruments are necessary in order to allow supreme courts to fulfil their main duties, that is, the administration of justice in individual cases (private function) and providing for the uniformity and development of the law within their respective jurisdictions (public function). If the number of cases at the supreme court level is too high, the result is undue delays, which are mainly problematic with regard to the private function. It may also put the quality of the court’s judgments under pressure, which can affect its public and private function alike. Thus, measures aimed at avoiding excessive caseloads need to take both functions into account. Increasing the capacity of the court to handle larger numbers of cases may result in the court being unable to adequately fulfil its public function, since large numbers of court decisions make it difficult to guarantee the uniformity of the law and its development. Therefore, a balanced approach is needed to safeguard capacity and quality. As shown by the contributions gathered here, the nature of reform in this area is not the same everywhere. There are a variety of reasons for this heterogeneity, ranging from different understandings of the caseload problem itself, local conceptions regarding the purpose of the Supreme Court, and strong entitlements concerning the right to appeal to budgetary restrictions and extremely rigid legislation. The book also shows that the implementation of similar solutions to case overload, such as access filters, may have different effects in different jurisdictions. The conclusion might well be that the problem of overburdened courts is multifactorial and context-dependent, and that easy, one-size-fits-all solutions are hard to find and perhaps even harder to implement.

Francisco Franco’s dictatorship in Spain (1936/1939-1975/1978) was a modern form of authoritarianism, with a strong totalitarian period, like many other dictatorships of the time. Francoism occupies a place in history alongside other different dictatorships of its age, and a comparative analysis might prove to be a powerful tool in order to understand how, in the middle of the 20th century, such a repressive and authoritarian form of political control emerged. One of the most forgotten fascisms, which at the same time was influenced by and influenced other dictatorships, there are many aspects of the transnational connections of Francoism that remain under-researched. Following this methodology, thus, an attempt is made to situate Francoism in the context of the other dictatorships of the time, in an attempt to transcend explanations centered on the nation. The chapters cover groundbreaking topics such as the Spanish Civil War as one of the first total wars or Spanish fascism in context as one of the main European totalitarianisms. The chapters always have more than one dimension: they speak of interrelation, entanglement, collaboration and diffusion, and, in general, put the different dictatorships (essentially: Francoism, diverse Fascisms and Communism) in context and comparison.

In Republic of Egos, Michael Seidman focuses instead on the personal and individual experiences of the common men and women who were actors in a struggle that defined a generation and helped to shape our world. By examining the roles of anonymous individuals, families, and small groups who fought for their own interests and survival—and not necessarily for an abstract or revolutionary cause—Seidman reveals a powerful but rarely considered pressure on the outcome of history. He shows how price controls and inflation in the Republican zone encouraged peasant hoarding, black marketing, and unrest among urban workers. Soldiers of the Republican Army responded to material shortages by looting, deserting, and fraternizing with the enemy. Seidman’s focus on average, seemingly nonpolitical individuals provides a new vision of both the experience and outcome of the war.
