Desde la promulgación de la Ley 7/1985, de 2 de abril, Reguladora de Bases de Régimen Local, hace ya más de treinta años, existe un vacío legal que pretende paliarse con la aprobación por parte de determinados Ayuntamientos de Reglamentos internos, en los que se intentan regular entre otros aspectos: el ingreso y cacheo del custodiado, el régimen de sus visitas, sus derechos y deberes, ó como debe realizarse su vigilancia y traslado… Este libro es fruto de una reflexión personal sobre la necesidad de elaborar y aprobar una Ley Orgánica de custodia de detenidos, pues sólo así se preserva la integridad y el ejercicio efectivo de sus Derechos Fundamentales mientras su actividad deambulatoria se encuentra vetada.

The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the "Velasquez Rodriguez" case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social and Cultural Rights, reproduced in Part Four. Also included, in its entirety, is a report on the human rights situation in Haiti, a report requested by the Organization of American States Permanent Council in Resolution 502. La investigadora indica que es necesaria “una voluntad política real por transformar la realidad y romper con el pasado de violaciones de derechos humanos” y denuncia que “no se haya respetado el derecho de las víctimas a la verdad”. Los resultados del trabajo, según apunta López, se espera que sirvan para que las personas afectadas puedan defender sus derechos ante las instancias internacionales y la Audiencia Nacional española.
