A lo largo de tres jornadas se analizó en profundidad el marco jurídico de protección de la propiedad intelectual de los artistas plásticos, fotógrafos, ilustradores, diseñadores gráficos, video creadores y profesionales del arte electrónico. Juristas y autores debatieron en profundidad cuestiones como los derechos exclusivos y sus límites, el derecho de participación de los artistas plásticos, la remuneración por copia privada y la contratación de los derechos de autor. El seminario lleva el nombre de Diego Rivera e Ignacio Zuloaga por la defensa que estos artistas hicieron de los derechos de autor, significando con ello la reivindicación que la comunidad artística viene haciendo desde hace muchas décadas. Nuestro objetivo fue organizar un encuentro entre juristas y artistas del mayor nivel que, al tiempo que buscaba provocar el interés del mundo del derecho sobre el valor social del arte, tenía la intención de aumentar la conciencia de los artistas como sujetos de derechos y obligaciones.

Book excerpt: La presente tesis aborda la casi inexplorada y creciente importancia de las relaciones entre arte en redes, historia del arte y propiedad intelectual en el contexto del capitalismo cognitivo marcado por el trabajo inmaterial y la economía digital. Se ha de tener presente que la omnipresencia de un flujo ininterrumpido de obras de arte en redes y los discursos cada vez más numerosos en torno a ellas y a la historia del arte en la red en general han propiciado reflexiones que se interrogan sobre el valor de muchas de las propuestas formuladas en torno a esas relaciones, así como sobre las limitaciones que, al nivel mundial, están imponiendo los distintos gobiernos a la libre circulación de esas producciones, afectando con ello a la libre expansión del conocimiento. Tales restricciones están estrechamente ligadas a las leyes de propiedad intelectual promulgadas en los diferentes países. En el caso de España, nos referiremos a la última versión de la ley de propiedad intelectual de 2014. En el marco de esas reflexiones, nos preguntamos en qué medida el copyright o los derechos de autor han sido históricamente democráticos o no y, por lo tanto, si han propiciado la autonomía creativa de los artistas frente a las instituciones políticas, artísticas, religiosas, etc. Cabe, asimismo, interrogarse si ciertamente los artistas obtienen gananciales por los derechos de autor y, en términos generales, quiénes se han beneficiado de su trabajo a lo largo de la historia. En el mismo sentido, interesa saber cómo han influido históricamente esos derechos en el despliegue de las artes visuales. Todo ello, teniendo en cuenta que hoy el copyright o los derechos de autor restringen las oportunidades de los artistas para crear y ralentiza el desarrollo cultural en vez de potenciarlo. Más aún, determinan qué tipo de arte es lícito y cuál no. Sobre esta base, esta tesis se ha construido como un fractal que atiende a cinco grandes problemáticas que buscan descifrar la interrelación entre arte, historia del arte y propiedad intelectual. En este sentido, nos proponemos mostrar que numerosos antecedentes sugieren que, a lo largo de la historia del arte, dicha correlación ha sido fundamental para comprender qué tipo de arte ha sido promovido y reconocido por las estructuras de poder y, por otro lado, cómo el arte se ha desplegado y ha quebrantado esas limitaciones para configurarse en un aparato cultural libre y emancipador. Consideraciones de este tipo nos permiten desentrañar más nítidamente cómo los derechos de propiedad intelectual han interpelado e interpelan hoy por hoy el "arte de los nuevos medios", particularmente una de sus expresiones más representativas, a saber el net.art, así como a los especialistas del mismo y las tácticas a las que han recurrido para sobrellevar las problemáticas que los afectan y nos aquejan. Las preguntas fundamentales que atiende esta tesis son: ¿Cómo entronca la construcción del "sistema arte" con la propiedad intelectual?; ¿Qué implica la autoría (y su muerte) en el arte y en las leyes de propiedad intelectual?; ¿Cómo surge el "arte de los nuevos medios" y el net.art y su vertiente anticopyright?; ¿Cómo se ha expresado artísticamente el net.art frente a las leyes de propiedad intelectual?; ¿Qué alternativas presentan el arte en redes y la historia del arte frente a las leyes de propiedad intelectual en el capitalismo cognitivo? Estas interrogantes tendrán su correlato en las cinco partes que conforman la tesis y que, en términos generales, afrontan cada una de las problemáticas tratadas sobre la base de conceptos asociados tanto a determinados ámbitos propios de la historiografía de la historia del arte como a aspectos que han incidido en el desarrollo del "arte de los nuevos medios", y más específicamente del net.art, lo que da pie para determinar instancias que ayudan a comprender cómo hemos llegado a la trama que se despliega contemporáneamente entre arte, historia del arte y derechos de autor o copyright. Señalaremos, por último, que a lo largo de la tesis se hacen múltiples referencias y correlaciones con la historia del "arte de los nuevos medios", particularmente del net.art, en consonancia con la problemática central de la tesis.

La responsabilidad pública sobre el Patrimonio afecta también al reconocimiento de los artistas como generadores de PATRIMONIO CONTEMPORÁNEO. Una sociedad democrática es una creación social de aportaciones libres que encuentra en los autores su expresión más activa. El ARTE es un hecho social, tiene una dimensión colectiva que materializa los emblemas de las metamorfosis y cambios de la época.

During the three and a half decades of Francoist dictatorship, these exiles held that the Republic, not Francoism, represented the authentic culture of Spain. In this environment, as Sebastiaan Faber argues in Exile and Cultural Hegemony, the Spaniards' conception of their role as intellectuals changed markedly over time. The first study of its kind to place the exiles' ideological evolution in a broad historical context, Exile and Cultural Hegemony takes into account developments in both Spanish and Mexican politics from the early 1930s through the 1970s. Faber pays particular attention to the intellectuals' persistent nationalism and misplaced illusions of pan-Hispanist grandeur, which included awkward and ironic overlaps with the rhetoric employed by their enemies on the Francoist right.
