Book excerpt: No puede negarse que el Derecho Administrativo ha construido buena parte de su teoría sobre conceptos inacabados e imprecisos, sobre los cuales no existe, en algunos casos, el más mínimo consenso. Ejemplo de ello son las nociones de servicio público, interés general, utilidad pública, contrato administrativo, acto de gobierno y acto administrativo. La idea de referirnos a ellos surge de la revisión de nuestra jurisprudencia, en especial la referida a la acción de nulidad. Al analizarla con la intención de precisar el alcance que se le da a la noción de actos administrativos como objeto de esa acción, encontramos una relativa utilización de la expresión “acto complejo”, aunque concediéndole en muchas ocasiones sentidos distintos. La constatación de la referida variación para definir una figura poco estudiada en Venezuela, pero que parecía tener utilidad práctica o al menos justificación teórica pues se acude a ella ocasionalmente, nos condujo a continuar la búsqueda de los fundamentos de la calificación de los actos administrativos complejos, por lo que recurrimos al resto de las fuentes de estudio de interés: la doctrina emanada de órganos administrativos, específicamente de los órganos consultivos de la Administración y de la Procuraduría y Contraloría General de la República, en la que también observamos muchas formas distintas de conceptualización. Inspirados, entonces, en la utilización jurisprudencial de la noción para explicar supuestos de muy variada clase y en los escasos estudios sobre el tema por parte de nuestros especialistas, realizamos una investigación sobre el particular, que resultó muy interesante, y presentamos este trabajo en el que exponemos sus resultados. Particularmente, resumiremos aquí el sentido que creemos que tiene el concepto de actos complejos y lo compararemos con el concedido entre nosotros. El presente trabajo lo hemos dividido en cinco partes. La primera la dedicamos al estudio de la noción de acto administrativo complejo. La segunda se destina a su distinción con las figuras que hemos mencionado en esta introducción: actos compuestos, actos colectivos, contratos entre entes estatales de carácter público, actos colegiales y procedimiento administrativo. Por último, desde la tercera hasta la quinta parte, revisaremos el tratamiento que ha tenido la expresión en la doctrina y jurisprudencia venezolanas (III y IV), así como en la doctrina emanada de los órganos consultivos de la Administración Pública y de la Procuraduría y Contraloría General de la República (V).
