These orders could be used to restrict a person's freedom movement, association or communication and are designed as a preventative measure. There are two types of orders: non-derogating (that do not involve derogating from the European Convention on Human Rights), and derogating. Non-derogating orders will be made by the Secretary of State, after seeking permission from the court (although in cases of emergency the Secretary of State can make an order first and then refer it to the court for confirmation). Derogating orders will be the subject to full hearings by the High Court or Court of Sessions, with a right to appeal.

The judiciary's role, too, is restricted: constitutional structure and cultural norms narrow the courts' ability to check the executive at all but the margins. The dominant 'Security or Freedom' framework for evaluating counterterrorist law thus fails to capture an important characteristic: increased executive power that shifts the balance between branches of government. This book re-calculates the cost of counterterrorist law to the United Kingdom and the United States, arguing that the damage caused is significantly greater than first appears. Donohue warns that the proliferation of biological and nuclear materials, together with willingness on the part of extremists to sacrifice themselves, may drive each country to take increasingly drastic measures with a resultant shift in the basic structure of both states.

If approved by Parliament, this Bill will allow the Government to impose a series of restrictive measures, broadly similar to those available under the control order regime, on certain targeted individuals. The Committee accepted the need for such measures as a preventative tool against suspected terrorists but raised concerns about the role of Parliament in approving their introduction and the threat to security created by "time-limiting" the legislation. To safeguard and better monitor their use, the Committee further called on the Government to institute higher standards of legal review of any use of this legislation.

At the same time, peace and conflict studies seem to be excessively focused on problem-solving approaches, which overemphasise the role of parity during negotiations and misdiagnose the distribution of power both within conflicts as well as within conflict management, resolution and/or transformation approaches.
