Taking a new approach which combines critical discourse analysis with critical realism, this book shows how the fear of being labelled as an 'extremist' has resulted in counter-terrorism strategies which actually undermine moderating mechanisms in a democracy. Analysing the generative mechanisms by which the language of counter-extremism might actually promote violence, Faure Walker explains how understanding the potentially oppressive properties of language can help us transcend them. The result is an imminent critique of the most pernicious aspects of the global War on Terror, those that are embedded in our everyday language and political discourse. Drawing on the author's own successful lobbying activities against counter-extremism, this book presents a model for how discourse analysis and critical realism can and should engage with the political and how this will affect meaningful change.

In 2012, the International Labour Organization estimated that there were 21 million victims of forced labour across the world. Our current understanding of the exact scale of the problem is limited. The only systematic means we have for collecting data is the National Referral Mechanism (NRM) to which potential victims of modern slavery are referred. 1,186 potential victims of modern slavery were referred in 2012 - a 25 per cent increase on the previous year. The Government will go forward in three ways: through legislation in this Parliament; through non-legislative action across the country; and through upstream work in source countries. The draft Modern Slavery Bill will: consolidate and simplify existing slavery and trafficking offences; increase the maximum sentence available to life imprisonment; introduce civil orders to restrict the activity of those who pose a risk and those convicted of slavery and trafficking offences; create a new Anti-Slavery Commissioner role to galvanise law enforcement's efforts to tackle modern slavery; and establish a legal duty to report potential victims of trafficking to the National Crime Agency (NCA). The Rt Hon Frank Field MP was invited to run a number of evidence sessions to gather information and views from a wide range of experts. His recommendations will be fully considered as the Bill and action plan are developed. The action plan will also set out how we will improve law enforcement action in source countries, and take steps towards scaling up reintegration programmes

Book excerpt: Many of the world’s 40,000 International NGOs (INGOs) work in places where terrorist financing, sanctions breaches, and diversion are key risks. Almost all of the top ten recipient countries of humanitarian aid alone in 2015 were high-risk jurisdictions, for example, receiving more than £7bn between them. When they feel safe to speak, sector workers share sobering stories about what might have happened to some of this money. As INGOs struggle to keep up with worsening humanitarian needs, diversion risks and their complexity remain daunting. The demands of internal stakeholders, donors, banks, and regulators are diverse and even contradictory. Public scrutiny has magnified, but is not always well-informed. Institutional donors transfer ever more risk to implementing partners, while some banks seek to avoid this business altogether, pushing some NGOs outside the global banking system. Looming over all of these converging pressures is a latticework of austere international sanctions and counter-terror regimes. It is no surprise that INGOs find themselves struggling to reconcile this complex set of expectations with their charitable missions. Yet the consequences of failing to do so can be severe; future funding is contingent on reputation, and serious offences litter the regulatory landscape. The implications of breaches can be existential for organisations and criminal for individuals. Terrorist Diversion: A Guide to Prevention and Detection for NGOs is an accessible, pragmatic guide for international NGOs of all shapes and sizes. Book excerpt: This report considers the respective roles of ministers, Parliament and the judiciary in the arrangements proposed specifically in the provisions of parts 2 (detention and questioning of terrorist suspects) and 6 (inquests and inquiries) of the Counter-Terrorism Bill. Whilst the Committee does not criticise the process by which the Bill's proposals have been developed they do have concerns relating to the outcomes that have been reached. They look at the basic constitutional questions of: what should the maximum permitted time of pre-charge detention be (given the Bill's proposed increase to 42 days)?; and who should be empowered to authorise such detention? The Committee notes that the European Convention on Human Rights requires that those arrested shall be informed "promptly" of the reasons for their arrest and of any charge against them, and then be brought "promptly" before a judge (article 5 (2) (3)). They advise that if the House approves the time limit set out in the Bill, it will do so in the knowledge that the question of compliance with Convention rights is likely to be heard and ultimately determined by the Courts. They also feel that the decision making scheme set out in the Bill is too elaborate and complex. The Committee continues with examining the Bill's part 6 proposals to permit the Secretary of State to issue certificates requiring an inquest to be hld without a jury and proposed arrangements for appointing and removing "specially appointed coroners". They state that, in their view, Ministers should be required to apply to the court for a non-jury inquest, rather than being empowered to determine without any judicial oversight that there will be such an inquest.

The criminalization of incitement to terrorism has gained momentum, but no exact or generally accepted definition of this offense exists at the international level. What’s more, given that the criminalization of incitement to terrorism results in restrictions on the exercise of citizens’ freedom of expression, there should be certain limitations on those criminal measures to avoid unnecessary or disproportionate infringement of this fundamental human right. Nevertheless, there has not been a precise standard by which to determine how to draw the line between anti-terrorism and the protection of freedom of expression. Hence, it could be concluded that the criminalization of incitement to terrorism concerns how to balance security and liberty, and the safeguarding principles of legality, necessity, and proportionality should be fully observed in considering this issue. This book studies definitions of “incitement”, “terrorism”, and “incitement to terrorism” under the relevant international and national legislation, and points out the existing absence, ambiguousness, or substantive divergence in defining actus reus and mens rea regarding incitement to terrorism. It carefully considers the current need for and essential limitations on criminal measures against incitement to terrorism in accordance with the principles of necessity and proportionality, and particularly focuses on how to balance the protection of freedom of expression with the criminalization of incitement to terrorism. In considering how to draw a line between the two, the book formulates precise requirements for objective and subjective elements of this offense in accordance with the principle of legality. Given its scope, it will be of interest not only to academics, human rights lawyers and practitioners, but also to policymakers, as it offers an extensive evaluation of the effects and counter-effects of existing criminal measures.

Book excerpt: The Joint Committee on Human Rights accepts the need for a counter-terrorism power to stop, question and search travellers at ports and airports without reasonable suspicion, but calls for a reasonable suspicion threshold to be introduced for the more intrusive powers such as detention, searching and copying the contents of personal electronic devices like mobile phones and laptops, and taking biometric samples. The Committee welcomes the improvements made to the powers in Schedule 7 of the Terrorism Act 2000 to stop, question, search and detain at ports, but still considers that a number of significant human rights compatibility concerns remain with those powers even after the changes have been made. The Committee recommends a number of other amendments to the Bill with regards to preventive measures against anti-social behaviour. Whilst cautiously welcoming the Bill's provision to criminalise forced marriage, the Committee believes the new law must be implemented and monitored carefully to ensure that it is not counter-productive for victims. The Committee also recommends additional measures to protect against the potential for prolonged retention of DNA and other personal samples in criminal investigations.
