Amendment to Oregon Revised Statute 465.315 (1995; Oregon House Bill 3352) establishes policy and Utah Cleanup Action and Risk-Based Closure Standards (R315-101) sets requirements for risk-based cleanup and closure at sites where remediation or removal of hazardous constituents to background levels will not be achieved. This paper discusses the difficulties in effectively integrating potential current and future impacts on human health and the environment, technical feasibility, economic considerations, and political realities into environmental policy and standards, using these references as models.

Book excerpt: Across the United States, thousands of hazardous waste sites are contaminated with chemicals that prevent the underlying groundwater from meeting drinking water standards. These include Superfund sites and other facilities that handle and dispose of hazardous waste, active and inactive dry cleaners, and leaking underground storage tanks; many are at federal facilities such as military installations. While many sites have been closed over the past 30 years through cleanup programs run by the U.S. Department of Defense, the U.S. EPA, and other state and federal agencies, the remaining caseload is much more difficult to address because the nature of the contamination and subsurface conditions make it difficult to achieve drinking water standards in the affected groundwater. Alternatives for Managing the Nation's Complex Contaminated Groundwater Sites estimates that at least 126,000 sites across the U.S. still have contaminated groundwater, and their closure is expected to cost at least $110 billion to $127 billion. About 10 percent of these sites are considered "complex," meaning restoration is unlikely to be achieved in the next 50 to 100 years due to technological limitations. At sites where contaminant concentrations have plateaued at levels above cleanup goals despite active efforts, the report recommends evaluating whether the sites should transition to long-term management, where risks would be monitored and harmful exposures prevented, but at reduced costs.

Particular controversy surrounds the burn pit used to dispose of solid waste at Joint Base Balad in Iraq, which burned up to 200 tons of waste per day in 2007. The Department of Veterans Affairs asked the IOM to form a committee to determine the long-term health effects from exposure to these burn pits. Insufficient evidence prevented the IOM committee from developing firm conclusions. This report, therefore, recommends that, along with more efficient data-gathering methods, a study be conducted that would evaluate the health status of service members from their time of deployment over many years to determine their incidence of chronic diseases.

Consequently, WHO recognized that it was an appropriate time to update the original text. The purpose of the second edition is to expand and update the practical information in the original Blue Book. The new Blue Book is designed to continue to be a source of impartial health-care information and guidance on safe waste-management practices. The editors' intention has been to keep the best of the original publication and supplement it with the latest relevant information. The audience for the Blue Book has expanded. Initially, the publication was intended for those directly involved in the creation and handling of health-care wastes: medical staff, health-care facility directors, ancillary health workers, infection-control officers and waste workers. This is no longer the situation. A wider range of people and organizations now have an active interest in the safe management of health-care wastes: regulators, policy-makers, development organizations, voluntary groups, environmental bodies, environmental health practitioners, advisers, researchers and students. Book excerpt: The Department of Toxic Substances Control (DTSC) of the State of California Environmental Protection Agency is in the process of complying with the Regulatory Structure Update. The Regulatory Structure Update is a comprehensive review and refocusing of California's system for identifying and regulating management of hazardous wastes. As part of this effort, the DTSC proposes to change its current waste classification system that categorizes wastes as hazardous or nonhazardous based on their toxicity. Under the proposed system there would be two risk-based thresholds rather than the single toxicity threshold currently used to distinguish between the wastes. Wastes that contain specific chemicals at concentrations that exceed the upper threshold will be designated as hazardous; those below the lower threshold will be nonhazardous; and those with chemical concentrations between the two thresholds will be "special" wastes and subject to variances for management and disposal. The proposed DTSC system combines toxicity information with short or long-term exposure information to determine the risks associated with the chemicals. Under section 57004 of the California Health and Safety Code, the scientific basis of the proposed waste classification system is subject to external scientific peer review by the National Academy of Sciences, the University of California, or other similar institution of higher learning or group of scientists. This report addresses that regulatory requirement.
